I'm a subcontractor and material supplier where our customer purchased materials only from us, and picked up the materials from our warehouse. They later said it was the incorrect material, kept the materials (even though we offered to take it back and refund the whole project), and claimed fraud so that the credit card company would reverse the charge. Even though we had signed documentation, the credit card company sided with the customer.
If the question is whether or not you can lien the work of improvement, the answer is yes, to the extent of your labor and material was used in the work of improvement. Don't miss your deadline to record a lien and serve a stop payment notice - within 30 days of recordation of a notice of completion, or within 90 days of completion, if no NOC was recorded. Good luck.
