I'm an electrical sub contractor on a residential job in North Carolina that has recently been completed. The home owner paid the GC, but the GC did not pay me. I filed a mechanic's lien through Levelset. The homeowner's atty. called my to tell me that I am wasting my time and money because the home owner has already paid the GC and that my only recourse is with the now bankrupt GC. He said the court will not make the home owner pay twice, and that if I pursue this, I will also have to pay all the court costs and attorney's fees because I will lose. Is he correct? Is the home owner clear because he paid the GC?
