My contractor is nearing the end date in the contract ( next week) and there is a great amount of work left to be done. Some weeks he only sends his workers for two hours before pulling them to other jobs. At this rate it will be many more weeks for completion. If he doesn’t complete on time does he breach the contract? Can I then fire him and hire someone else to finish? I still have approx. $5,000 to pay him, due upon completion, but the work left to do is more than the $5,000. Please advise.
This question is very specific and will be controlled by the written contract. The only recommendation that can be made here is "call an attorney." There is a risk of paying for this job twice if the contractor is not in breach.
