Am I responsible for a mechanic lien for work done to my property prior to owning it

CaliforniaMechanics Lien
Anonymous Contractor

Hello, I purchased a condo in January of 2018 in California, two months later a mechanics lien was placed on my property two months later. I reside in an HOA and was unaware at the time of purchase they had a pending ligation with a former contractor who had done work on the property. The HOA had found out the contractor did not have a current license or insurance. Am I responsible for the lien? Thank you, Ashley Olguin

an unlicensed contractor cannot enforce a mechanics lien placed on your property. While the unlicensed contractor can record a mechanics lien against the property, he/she cannot win a foreclosure lawsuit against it. He/she can file the foreclosure action, but cannot win due to not being fully licensed at all times during the contract. You should get a full analysis from a construction attorney to formulate a strategy to get you out of the claim from the unlicensed contractor.

You are if you had notice of the lien, or if it appeared on your title report.
