Hello, I am a truck driver for a company based out of Chicago. I am a Kentucky resident. I have hauled many loads over a couple of weeks and have yet to be paid. They give me numerous excuses as to why this hasn't happened. I do have possession of their truck and trailer however, the same equipment that is used to perform my job. Construction was done on a commercial property, company that we sub trough is filling bankruptcy and complete construction went un paid till date. A second company purchase all assets from GC we contract and they tried to buy all pending PO pennies on the dollar we counter but was decline as they are negotiating. I am a subcontractor who provide a service based on a time and material agreement. All work that was requested was performed to the best of our abilities given the jobsite conditions. General contractor is refusing to pay, stating that the issue is not fixed, even though we have provided proof of work and copies of our written agreement for payment terms that GC did approve. Also provided proof that we told the GC prior what the jobsite conditions needed to be so we could preform the work, we were then asked to come and preform work. Assuming they were ready for us to come and preform the work we showed up and did what we could. Job is not complete and that was communicated that is due to lack of proper onsite conditions. Spoke to GC about unpaid invoice, GC commented that he would just bond around a lien if I filed one. This property has a homeowner so I am not sure if he can actually do that to avoid paying me. My mother passed away 3 some years ago, willed the house she'd been living in to my younger sister; I'd moved here to Mississippi, almost 9 years ago, at mom's request, to assist her during some health issues she was having.
