We are a Memphis, TN based flooring company and provide new flooring installations as requested for apartment communities. We provide services to two Florida properties managed and owned by the same company with large past due balances. We are new to Florida and have never been required to send a Preliminary Notice at 45 days - since each installation is a different job, does that 45 days start from the very first installation, or after each one? Does the preliminary notice requirement even apply to us? We do require new customers to sign a credit application that outlines our 30 day terms and the potential consequences of leaving balances unpaid, and the owner information is listed on that signed application - does that cover us as "contracted with the owner?" Is there a way for us to file a lien?...Read More

We want to give them a conditional progress payment release with the outstanding amount of $5,909.99 due. The form I populated shows Maker of check xxxxxxx Amount of check $5,909.99 Check Payable to xxxxxxxxx We are not swapping this release for the check at this time but want to give them the release so they can get their money, we are waiting their payment to be processed and mailed. Around 5 years ago, I had a plumber do work to unclog a sewer line for me on a rental property in Lee County, FL. I paid him $350. even though he failed to complete the job. He sent me an additional bill for $300. for extra time he spent, but STILL was unable to clear the line. So I paid another plumbing company who had the equipment to remove the shale in the cast iron pipes to allow the flow of the waste water. Problem solved. I spoke to the 1st company and argued that I should not have to pay their additional bill since they did NOT solve the problem and I had to hire a 2nd company who did. The 1st co. filed a mechanics lien on the property about about 5 years ago which I assume was done properly. Being extremely busy with other work of I had forgotten about it and am now wondering what kind of problem this will be for me. Is the lien still in effect? Do I have to pay or sue to remove it? We are doing a job and have subcontractors doing the work. Some of them have worker's compensation exemption forms and some do not. Is there a blanket waiver we can have them sign to exempt them from the one specific job? Would each member of the sub contractors team need to sign this or just the owner of the company?...Read More

My contractor sent me an e mail confirming his price of 20 k to demo my property. ( no other contract was signed and we paid over the 20 k requested. ) After the job was over he said the costs were more greater than he had thought and sent me a bill for an additional 7k .
