Hello, I am in Colorado and I filed an intent to lien to get my final payments moving from a project that has been done a while. On 8/30/21 my lien rights will be gone and Levelset is unaware of Colorado's ability to file extensions of notice of intent to lien. I really DON'T want to file a lien. I am just hoping to get their attention as well as keep my rights open. Please advise since Levelset is missing the extension step in their processes....Read More

We sent an NOI and filed a Lien on a job in Colorado, without Prime Contractor info. We now have that information and are still well within our lien rights period. We have already previously asked the legal team what to do and they said the correct process is to release the lien and refile an "amended lien" as the original lien statement. We have released the lien and are about to order the NOI and then wait the 10 days to file the amended lien. My question is, can I order an NOI normally in levelset, or do I need to send an "amended" NOI the same as I have to send an amended lien?...Read More

In Colorado, contractor's work ended on my rental remodel in Nov or Dec 2020 (defect repairs in Dec), exited house last time on 08Jan21, fully paid, paid extra to get out. Contractor recorded Mechanics lien statement against house and myself on 31Mar21, for $51K, without any NOI service or affidavet and only 9 days after notarized, numerous errors on statement. I've had $5K in attorney bills to sort issue. House on lien sold, closed 28May21. Land Title ecrowed 1.5X lien amount from my proceeds, pending lien resolution to insure title. No action of any kind has been taken by contractor to cure or foreclose. The CRS 38-22-110 deadline of six months since work ended for action was 08Jul21, lien is invalid, not to mention spurious, in bad gfaith, excessive. Requests to contrctor to volntarily release with no response. Question, with no need to file suit to "show-cause" as lien is no longer valid, how do I simply petition court to dismiss/discharge lien so i can record a release, get my escrowed funds released from Title?...Read More

The client has a food truck, but was acquiring a building for a stand alone restaurant. We've done the work, invoiced (which he acknowledged receiving and as his, have a signed proposal, have emails tracked with Hubspot every single time we followed up as well as each time he opened. He is not lying saying he didnt read or sign anything. Its a pretty cut and dry case in my opinion. Hi there is a subcontractor that doesn't have a bond program (they are the ones doing the work), so the owner is having his other company issue the bond. Even the contract is being reissued between the GC and the new sub. However this new sub won't be doing the actual work & neither sub is on each others insurance policies. I hired a contractor who bid the job at $50/hr. He informed me that he needed help and hired his friend to help. The bill I received charged 29.5 hours for both the contractor and his friend. I told the contractor I did not agree to pay his employee $50/hr and that the contractor is responsible to pay his employee. Contractor said his help is an independent contractor, which I said he was not authorized to hire an IC without my approval and I was not provided a certificate of insurance for his help. The contractor said his help was working under his GL insurance. There is no contract and the contractor is still billing me $1475 for his help. Is a prime contractor relieved from prompt payment obligations to its sub if the public entity does not pay the contractor? For example, prime must pay sub within 7 days of receipt of payment from public entity. What if public entity does not pay?
