Extension of intent to lien

ColoradoLien Deadlines

Hello, I am in Colorado and I filed an intent to lien to get my final payments moving from a project that has been done a while. On 8/30/21 my lien rights will be gone and Levelset is unaware of Colorado's ability to file extensions of notice of intent to lien. I really DON'T want to file a lien. I am just hoping to get their attention as well as keep my rights open. Please advise since Levelset is missing the extension step in their processes.

Good morning. The attorneys who answer questions on Levelset are not related to Levelset or work for Levelset. We are just volunteering our time to help contractors. Contact Levelset customer service and provide your suggestions. The questions you post just go to these volunteer attorneys, not to Levelset. As to the Notice of Extending Time to File Mechanics' Lien Statement under CRS 38-22-109(10), contact an attorney to provide the form and advice on the process. This, as I am sure you understand, does not help general or prime contractors. The notice, and the extension it provides, will expire six months after recording the notice or four months after completion of the structure or other improvement, whichever occurs first. If the structure or other improvements have not been completed before the expiration or termination of the notice, the claimant may file a new or amended notice that will remain effective for an additional period of six months or four months after the structure or other improvements are completed, whichever occurs first. Reach out to a Colorado construction attorney for assistance on the lien and other possible options.
