Our company (we are a supplier) received a Conditional Waiver and Release on Final Payment from one of our customers with 3 properties listed. 1. Are we allowed to sign off on documents with multiple properties listed or should we have a document per each property addressed? 2. On the Conditional Waiver and Release on Final Payment, to our knowledge 2 out of 3 properties the job would be finished and completed for while the 3rd property we were informed the customer would want to place an order for tomorrow. I have a signed contract by the homeowner to perform water restoration on a house located in Texas, contract states " we will bill homeowner insurance company however if the insurance company denies the claim then the homeowner is responsible for the bill". The work on the subject property was completed on Sept, 18, 2021. The claim was submitted to the insurance company on Sept, 20, 2021. Homeowner sold the house on Oct, 20, 2021. The insurance company denied the original homeowners insurance on Oct. 23, 2021. , I notified the original owner of my intent to file a mechanics lien to secure payment. On October last year my boss sent/file the lien affidavit and claim. Customer never paid and now his lawyer contacted us saying that if we do not release it they'll proceed to file a suit. We began with the lien notice, then they said that it was invalid and then the lawyer we were working with said that it was really valid our petition. Please , I need some advice here We are a mechanical HVAC contractor. Client refused to pay because we supposedly didnt comply . We proved that we were several times at the jobsite and customer wasnt ready for us to continue, so when he was actually ready we couldnt make it next day as he was requesting. I DID some labor work for my dad's girlfriend. We agreed upon $15 hr and I worked for hours. She has been giving me cash here and there. However, now that the job is complete she is arguing over the hours I worked and how much is actually still owed to me. Now she has sent a check via certified mail and on the memo line has written Cash Paid $775\Paid in Full. The check amount is$225. She still owes $1636.00. I seriously need to cash the check as she hasn't paid me anything since mid October. There is no contact in writing as this was only a verbal agreement. I have a situation where I hired a company to build a pool, deck, outdoor kitchen, spa and fire pit. It has been 10 months since the dig and we have partial tile/coping and gunite and nothing else and company abandoned the project. We have paid them a little over $69K out of the $123K project and only about 20% of the work has been completed. I am now getting phone calls from the Excavation crew, tile/coping crew that they will put a lien on my house for non-payment when it was not for me to pay - it was the pool company ( they had my money). How can i recover my paid funds to finish my pool project and not have a lien on my property since it was not my fault the sub-contractors whom I do not have a contract with did not get paid?
