What are my options?

TexasCollectionsMechanics LienPayment DisputesRecovery Options

I DID some labor work for my dad's girlfriend. We agreed upon $15 hr and I worked for hours. She has been giving me cash here and there. However, now that the job is complete she is arguing over the hours I worked and how much is actually still owed to me. Now she has sent a check via certified mail and on the memo line has written Cash Paid $775\Paid in Full. The check amount is$225. She still owes $1636.00. I seriously need to cash the check as she hasn't paid me anything since mid October. There is no contact in writing as this was only a verbal agreement. Could you tell me the law in Texas regarding this type of matter?

Don't cash or deposit the check. A marking of paid in full is akin to an offer, and your depositing the check is an acceptance. Even if you mark out the "paid in full" language.

You should consider writing to your customer by certified mail to set out the facts and to demand the relief that you want. Attach support for your position, and include photographs of your work.

Make sure that your letter is professional and business like as it could be evidence later.

If need be, consider filing suit in small claims court, using your letter as evidence.

Good luck.
