Am I eligible to file a Lien?

We were subcontracted to furnish and install equipment on a residential project in August. The job was completed on August 10,2021. The final invoice was sent to the client on August 12,2021. Now, the client is not responding to calls and emails. According to the dates I saw online the Lien should have been filed yesterday - November 15th. Am I no longer eligible to file a lien?

The legal analysis would start with a review of your contract and then extend to an analysis of what sort of residential project (owner's homestead, less than four units, more than four units, etc.) as the law differs with the kind of project, what notices you have already provided, whether you contracted with the owner or a general contractor, etc.

You could have rights to a retainage lien.

Retain a construction attorney to evaluate your legal position and to provide advice.
