We are a masonry subcontractor; we did work on a public school. We billed for retainage on 03/20/20 and still have not been paid. Since then a change order was issued for additional work in August 2020. We last worked on site 08/14/20. Now, we are owed retainage $7,000.00 and change order amount $8,000.00. We haven't been able to bill for the change order yet. Please let me know our options. Should we send a written notice of claim on retainage only? Or include the additional $8,000?...Read More

My husband is a prime contractor, that contracted directly with the homeowner on a deck remodeling project recently. His last day of labor was 8/16. The home own misunderstood the original estimate he agreed to, and was unhappy with the (in his opinion) quality of work conducted and asked to cease the project which was 90% complete already. We have requested that he compromise and pay and additional $6900 for work already performed, and have discounted from the total due nearly $5000. The estimate was send to the husband via quickbooks, and acceptedwithin the system. He has paid multiple invoices sent from the estimates in quickbooks as well, aside from the last invoice that is still outstanding. Are we able to file a lien? What is the requirement that we must send the contract to the county clerk? I read that might be for new construction only but am not sure? Would it be the lien that goes to the county clerk? Can you help us clarify what our next legal steps would be? The work we provide is only of high quality. We have never had such a compliant- this is clearly the home owner being distracted, not understanding what he has agreed to, and wanting this work for free. ...Read More

I am an owner our A/C stop working contractor was call to fix the A/C he said we need a new A/C. he placed the new A/C three days later the A/C stop working he was called again. the technician requested to be paid for $120 for his work. I called the owner he claimed the work he did wasn't related to the new A/C he claim he clean drain lines and adjusted float switch. I wasn't home and he didn't discussed with me what kind of work needed the work was not authorized by me. by consulting with A/C license he was suppose to make sure the lines are cleared when he place the new A/C and make sure the float switch is adjusted. with his affidavit claim the amount he's claiming is $812.50. Hello, during the month of April, my electrical company from Texas was hired to do a job in Oklahoma, with a contractor from Texas. There was four different phases to the job, the first three were paid for, but the last one was not. We have sent reminders for the contractor to pay, but the money has yet to be seen. When i entered in a project into LevelSet it was set as a Residential. Upon further review Scout found it listed as Commercial. So when we sent our Notice of Non-Payment it was under Non-Residential but should have been a Residential. Where do we stand in regards to this? Are we still protected? Good afternoon, We are a general contracting company in Texas and did some plumbing service calls on an apartment complex with multiple individual owners. Each unit is owned by a certain individual. They are run by a board of directors, and that board has a management company they have hired. They have not paid for some services dating back to January 2019. I was going to send an NOI to each owner unit we have done services on. The owners don't know about what's going on, as they believe their money is being used for the good of the property and paying the bills. So if tey get an NOI, they'll be surprised. I’m a pressure washing business and was hired to clean apartment complex for $4,000. I was fired for not showing up on time. I told them to give me till Friday to complete entire job but, was fired Thursday morning at 9:21am for a No show for that day. I was actually about 20 minutes from pulling into the complex.
