I am in Indiana and removed a dangerous dead tree from the property and I am not being paid. My lawyer does not think that tree work falls under the Indiana statute but I see case law like referenced in the article above that since I am making a permanent improvement to the property I should be entitled to the mechanic's lien. I am a homeowner and I had hired a friend who is a contractor to remodel our home . He has a business and was not able to work during the corona virus . We hired this contractor and gave him a deposit of 7,000 cash ( he had requested cash ) to buy supplies. and then he came back wanting more money saying he needed to pay bills and we gave him 14,000 . The original estimate / contract is only for between 18.400- 19.400 and we over paid him since the original estimate did not include framing out garage lien to and he do extra framing on a bathroom door. He has now quit working on the home and has threatened to put a mechanics lien unless we pay up another 5,000. We have no signed contract of any kind. We have been asking for a breakdown of the bill of what was paid and what he is claiming we still owe. We have no tax ID number and will give us a detailed bill of the supplies purchased. We have been receiving threatening texts . We have damage that this contractor has done to our home. We have given him a total of 21,000. What can I do in this case . Please help. We are trying to sell our home and he knows this and says he will file a lien unless we give him the money but, he says he is not providing us with a detailed bill. There is an abandoned property adjacent to my property. The owner of record is a company that has been out of business for many years. I have taken care of the property adjacent to my property for over 17 years now and would like to acquire it. Today, there are a number of trees that are dead/dying or falling over presenting a real hazard to life and limb. We hired a general contractor to rehab a home. An electric company with whom we never had contact put a lien on the home with no notice. The electric company says they had a verbal contract with somebody (but are not sure who that person is) to do over $10,000 of work on our home. The general contractor says he did not authorize the work of the electric company or receive any quotes for the work. The electric company says the account for our home is under the name of our property manager. The property manager says he did not authorize the work or receive any quotes, either. The electric company cannot produce the original quote they say was approved by somebody verbally or prove they sent it to anyone. Some sort of work has been completed, but either nobody "remembers" authorizing the work or the work was never authorized. The general contractor knew that some work was being done but didn't stop the work. What authority or law gives the electric company the ability to put the mechanics lien on our home?...Read More

We fabricated and installed a solid surface countertop for which we were paid and the owner asked us to do some other work for him so we agreed to install some old doors for him we did so and he wanted more work done this work had not been paid for at $325 but we agreed with him to do all the trim and doors and a shower tile job for $55 per hour for 2 men he agreed the work is done and he has given $600 in cash before finishing but now hands us a check for $1900 but the total is 96 hours for $55 per hour which is $5280 plus the $325 previously unpaid ...Read More

I helped a buddy roof this ladies house there was no written contract but she contacted us to do the roof. It was a nightmare and the amount of repair was alot. So naturally the price increased almost double.we explained all of this to her b4 proceeding with the work. She agreed and we finished the roof . Now she is trying to only pay 10% of said bill. We've offered to pay for roof inspection by an outside source and nothing. The work is done to code and in my opinion. Was a great job done and she even said it looked great. An Indiana question: I am looking at this for two types of companies (providing residential not commercial work): an HVAC/Plumbing/Electrical provider and a General Contractor who primarily does kitchen, bathroom and basement remodels. A) On this site it states that a mechanics lien can be used for work that is a “permanent improvement.” I can see a house foundation as being permanent. However, does the above work qualify for a mechanics lien in Indiana due to the fact that after a period of time it would possibly be replaced? B) Also on this site, it states the mechanics lien is good for 1 year. 1) Is that true? 2) Does that mean it has to be re-filed each year? 3) Is it able to be refiled?
