I’m working for a gc he subs out work to me ,I had originally told him I would quote him by Job but he said that it was too much to work by hour and send him in the hours tooken afterwards,now he don’t want to pay and says it’s too much and keeps beating around the bush bringing up older job ,, but there is no contract signed from either party, the building where we worked Is like offices for lease so does that matter ? Hired Contractor to paint our house. We agreed upon a rate of $160 per day and he said it will take him 2 weeks to complete. After a week we noticed he was going very slow and taking his time. He said he will need another 3 weeks to complete everything(4 weeks total when we agreed upon 2) we said this is unacceptable as you originally promised 2 weeks. We then agreed on a fixed amount instead of the original 160 per day. After completion he took the money and left. We just got a mechanics Leon notice from him months later saying we owe him more money as he is trying to charge us for 160 per day for the 4 weeks. We never agreed upon this. We never signed any documents either discussing this. Our agreement was 100% verbal. Does his claim Have any merit? We will be forced to pay the amount he’s trying to get from us?...Read More

Good day, we are a company in FL who built Indoor Pool Dehumidification Systems (mechanical hvac). We sold a system to the rep firm in Illinois who then sold it to the mechanical and then mechanical sells to the Hotel. We've been trying to get paid since May 30th and there is no response from anyone as to the final balance for this equipment.Can we file a lien against the hotel where the equipment is installed? If so is it considered a Mechanics Lien or is there one for "SUPPLIERS" that is different. CNN Construction in Hillside IL just issued use a mechanics lien for $6k non-payment for a roof service. They completed the work in May. Insurance paid for the estimate in the amount of $8500. They received payment before the work started. We waited a week and work finally was done. Then we get an invoice in August stating the work was around $14000 and that they added some upgrades. We were never informed of these "upgrades" and in fact the upgrades were not done (ie new gutters which they added $3k for). We reached out to our insurance to see if they notified them of any adjustments to the estimate and they we not aware nor were they contacted. The claimed the work was completed in August but it was not. It was completed in May. They sent threating emails and called unlisted and left nasty phone messages saying they would issue a lien if we didn't set up a payment plan. For a to-be-owner-occupied residence: May a subcontractor's lien be valid if the IL Notice of Subcontractors Claim/Mechanic's Lien Claim is not prepared or served within 90 days, and, on its face, the alleged last date on which materials were delivered is more than 90 days from the called date on which the Notice was created? What if that same notice also contends certain labor and materials were delivered; but, such labor and materials were indisputably not delivered - potentially through no fault of the subcontract (fault lying with GC)? I recently received a PO for a job site, GC had us send a crew to their home office for 4 days of training. They said they werent moving forward with us on day 4. We worked for them several times and they requested that we have our certs in Fulton name essentially paid employees. They gave the guys a Fulton safety banner and Fulton shirts. We have pre photos that are timestamped and have proof of Fulton knowledge of man hours spent on site, submitted a rigging plan and photos to Fulton. They sent us a letter in response. Saying no they don't owe us anything. We also paid the guys for being in class. We have all certs and fulton wanted us to have certs in there name for "insurance purposes". We sent an intent to lein. I placed an order for a custom door for a customer in Illinois. He signed a CC authorization that the product is not returnable. We got into a dispute over the timing of the 3rd party installer that i recommended but he retained. Customer cancelled the CC and I won the first 2 times and third time he was succesful. Good afternoon! We're an architectural firm in Illinois that was hired by the GC/Owner's Rep. for two projects; we have not received any payment for either project. First invoices were issued in November, 2020 and December, 2020. Total amount due is over $80K for both projects combined. Our Client claims that numerous checks were intercepted and fraudulently deposited. Our last communication with the Client was via email on 6.21.21 when she informed us that the funds would be deposited into her account between 48 and 72 hours and she was going to deliver the checks to our office personally. That didn't happen. I left several voicemail messages and sent several emails and have not heard back from our Client. We have never filed a lien before so I need assistance with selecting the correct form and completing it as well. Are we required to file a notice of intent prior to issuing the formal lien?
