I’m working for a gc he subs out work to me ,I had originally told him I would quote him by Job but he said that it was too much to work by hour and send him in the hours tooken afterwards,now he don’t want to pay and says it’s too much and keeps beating around the bush bringing up older job ,, but there is no contract signed from either party, the building where we worked Is like offices for lease so does that matter ? I am a property owner. Our contractor walked away from our shop project, after he was paid in full and did not complete the project because he burned our house down. We filed a complaint for mediation with the CSLB which was delayed due to COVID and the contractor's license being suspended for a time. We were finally issued a formal citation which we forwarded to The Guardian Group representing the surety bond company. They agreed to the total damages in the citation of $15,196; however they took a credit of $9,200 claiming this amount was owed to the contract. Unfortunately, we had 4 contracts with this contractor. All 4 were paid in full. They are creating an over payment of $9,200 by taking the credit against the damages. The problem is that we are running out of time on the bond claim deadline which is 12/30/2021. Is there any way to get the deadline extended? Everything took much longer than normal due to COVID orders. Plus, we lost time while the contractor's license was suspended. the CSLB didn't work the citation while his license was suspended. Hello, I have a customer who refuses to pay for the mitigation service rendered and refuses to contact her insurance to file a claim because she knows the claim will be denied due to a long term leak that created a lot of visual mold. I would like to know if Levelset is able to draft a 'Demand Letter' before I file the small claims documents? What steps do I need to take before filing for small claims? Hello, my father is a contractor who agreed to remodel many aspects of his close friend's daughter's house. There is no written contract, but there are text messages explaining that it would be a "time and materials" contract. The homeowner paid for a couple months of the remodeling which they called phase 1, but did not pay for the completion /phase 2 because she said the price was more than she expected. From your website, I see that Colorado requires a written contract for costs over $500. My father says she owes him around $17,000 for his work and the materials. My question is what can my father do to get paid? Could the text messages count as the underlying contract? Or could the contract be implied because he has basically already completed the work? From googling, I found a term called unjust enrichment. Is that an option? Could we sue based on the value he added to her residence? Thank you for any and all thoughts you may have....Read More
