I quoted some paint jobs for a client, and they paid the deposit for the two jobs. The first paint job took longer than expected and at the end of the he job, the client asked us to stop working. This particular project took 2 to 3 coats of paint to get a good coverage. Not sure how I should charge. The client accepted my bid but I think those terms have been compromised since we were asked to stop? So instead of the original price we agreed on, should we now charge the actual costs for that job or just the original invoice?...Read More

Had a flood in basement and some other areas. Hired company to dry out floors, etc. Tore out drywall that got too wet. Promised they were going to put new walls in, etc. which they did not do but tried to get max amount out of insurnace company by inflating the costs. Insurance had their own estimate done and came up with less than half of what this company wanted to charge me, now they want to put a mechanics lien against my property for not paying the larger sum....Read More

I am an LLC general contractor that supplied labor and some materials through a remodel process and my client has terminated me for cause of endangering a timely completion of the project as I did not state one in my contract nor have I provided one- it’s nearly been three months come 14 July 2022 and I also don’t have a signed contract from the customer. What are my options for collecting payment owed before completion of the project? We are being asking to sign a Forbearance Agreement. By signing this agreement, we are stating we agree to the terms of the company to pay off it’s balance in 2022 in set amounts. The work we performed were on offshore decks and platforms and a traditional lien is a route we are unable to take. I'm a subcontractor working on a large project and we have a contract stating that we are responsible for all hoisting/rigging/installation of the equipment we are contracted to provide; however, according to project plans there is no feasible means of delivery for the equipment requested to the desired location in the timeline desired by the GC. This was overlooked by the architect on record and their contracted design consultant. Would we be required to point out those issues? or, more generally, where does the fault/liability lie if the issue is overlooked and the discovery is made at time of delivery (delivery into final room in GCs desired time frame would require breaking of concrete slab, removing PT lines, breaking of load bearing wall, renting of crane to drop equipment into room off a ramp, and then repair work)....Read More

Contractor aware of critical correction items needs to be made, but remain unresolved. project has been stalled for over one month and no signs of work resumption. Advanced payments has been collected. We can't let contract keep dragging our feet and needs to move forward with the project with someone else who knows what they are doing. Received "Notice to file lean" from a contractor. I had never heard of this contractor, certainly had not hired him. Turns out, my contractor had hired him, without my knowledge to do some work. I am a homeowner who hired a structural engineer to complete a set of plans for a metal building on a residential property as well as plans for a home remodel. The contract was signed in Sept 2021 and I was given a 2 to 2.5week schedule. We are now 4 to 4.5 months out and they have not sent anything for the home remodel. The metal building was to be a square tubing building, teh first set of plans that were finally sent 3 months from signing the contract was an I-Beam structure, and now the engineer is saying he will not finish the project because I am changing my mind to many times. The homeowner refused to sign a traditional construction contract, but did agree to a cost-plus arrangement although no legal document was signed. At each payment interval, the homeowner would sign the contractor's invoice and make payment to the contractor. Now that there has been a falling out between the homeowner and contractor, can the contractor file a mechanic's lien?
