Registered (Torrens) Property

A handful of states use the Torrens title system, which is an alternative method of registering titles to real estate. Under this process, an examiner of titles will review the history of the property to determine if “good title” exists, and will issue a certificate of title.

Few states still use this method of title registration, including HI, IL, MA, MN, NY, and OH. Contrast this method with “recorded land” which is the more common method of real estate which is to file a deed when ownership is transferred. For contractors in Massachusetts and Minnesota, this distinction is crucial to the lien process. MA and MN liens against registered (Torrens) property must be filed in the Registrar of Titles, of the Registry District of the Land Court; respectively.
