i was leasing a building to operate my business out of in Alexandria LA, for approx. 3 years. after the first two which were within the original 2 year lease we signed the last year we opted to go month to month because sales were slow from that store and we could not seem to find good help in that area. I recieved a call from Troy Beauford the owner of that building and the owner of The Yankee Clipper landscaping which was a highly rated lawn service in that area. oy asked if I would like to buy the building and I declined . He then asked if he could show building to prospect buyers and I stated only if he accompanied them when in the building due to all the inventory and equipment we had at that location. he agreed . about 3 weeks went by and I recieved anj e mail from a giuy named ricky ferris and he stated he was the new owner of the building and would like us to send the rent checks to him instead of troy. I called Troy and he confirmed, but i was ready to pull out of Alexeandria La all togeather and focus my business where revenue was coming in. I informed Mr. Ferris and he was upset but nothing he could say . we gave a 30 day notice and when time came to retreive our stock I had hired a crew and moving truck and sent them on a 3 hr trip to Alexandria. When they arrived at shop locks were changed and M r. Ferris was not their like he promised to let s retrieve our belongings. Mr Ferris was reached by phone by Corporal Flynn of Bienville sherriffs office whch I had called for assistance when the moving crew informed me what was happening. Mr Ferris told the Corporal he wanted 3k to release inventory and the corporal told him he cannot hold our belongings hostege and if he felt we owed him money that would have to be done in civil court and Mr Ferris reluctantly agreed and said for me to call him and we could arange another day to meet him to nlock building to retreive belongings which included new and sed equipment for industrial/commercial cleaning applications ,Chemicals,office furnature,signage,kitchen furnature for break room a overnigtht queen futon with wool matress, and 2 offices full of furnature along with our air compressor, fork lift, and all wi fi equipment and computers everythig we needede to run our business in excess of 50k. Well Mr FERRIS dodged my calls and e mails for about a year so I called previous owner that I had made the original deal on trhe lease and troy stated that he would be found liable because he led M r. Ferris to believe we were the perfect tennant (never late on rent,fully insured, and the amount I paid for rent would more than cover his mortgage. When that didnt happen Mr. Ferris retaliated by keeping our belongings. Now I think they are both at fault but Mr. Ferris is the bully in this trying to get something for nothing and now he states all our belongings are not there because he leased it out to another company and he said I would have to get with them but they said they have no idea where my stock is. Now Mr Ferris playing molew again and cannot be reached. Troy Beaford started this mess and Mr. Ferris endxed it by stealing over 50 k in stock and belongings. Good evening! I am assisting a friend who owns a roofing company with a rather complicated situation and am hoping you can help assist me in moving forward in the right direction. Here is our situation.... Back in August of 2020 he accepted a roofing job where he had to completely tear off the whole roof and replace it along with other little side jobs he allowed the customer to add to the contract between the two of them that brought the total cost to $18,674.45. This amount does not include late fees, nor accumulated costs for the filing of a mechanics lien (which he was to late in filing so he paid the money, but per MN law, he did not meet the deadline in sending this to the homeowner). So my question is I was contracted to do stucco for a company I was a subcontractor they asked if I could do some drywall it's not my expertise but I do know how to do drywall I had did some drywall the previous two weeks and a couple other different jobs when it came time to get paid we only everyone only got half checks that we were told we would get the rest of our check as of that Monday I mean Tuesday because it was Presidents Day then I get told my services are no longer needed and I don't even get the rest of my check which was roughly $1,100 that he still owed me I'm a single mother this is hurt me in detrimentally I don't have the money to file even a lawsuit if I wanted cuz you didn't pay me I have pictures to prove my before and after work I have clock ins through the the places that we had to clock in at 4 my hours how do I go about getting the money...Read More

We had a roof put on our house about 1 year ago. We just got a bill from a subcontractor saying they were not paid and will put a lien on our house. Contractor says they were paid and "not to worry" because they have to file a complaint within 20 days and did not. From what I can tell, they have 4 YEARS to file a lawsuit. It's hard to tell who's lying (or mistaken at the least but something smells fishy). Do I have a right to the contractors receipt of payment to the subcontractor?...Read More

Hello, We are a 2nd tier sub on a project we have been complete on for 7 months on one building, 5 months on the other. Both projects are privately owned. Both have separate notice to owners filed. Both are part of a multi-building park complex in FL. We did not sign a contract with the first tier sub. We are trying to get our retainage. The 1st tier sub continues to say they haven't been paid retainage and we must wait for that. The 1st tier sub has not even requested their final as of today 2/23/22. Both buildings are substantially completed, though I don't think the grounds of the park are substantially complete. I need to know if the FL payment laws apply?...Read More

If there is contract for over $500,000 that exists between the owner and the GC, can the owner opt not to hold retention so owner would not have to open an escrow account for retention? If so, can the GC hold retention on his subcontractors? If the GC can hold retention on his subcontractors, does that mean the GC is required to open a single escrow account as an "umbrella" for all of the subcontractors together? Or would the GC have to open a separate escrow account for each individual subcontractor? If the owner does not hold retention on the contract over $500,000, should the GC then not hold retention since, technically, the GC would be paid all monies owed to the GC since the owner did not hold retention on the GC? I hired a cabinet guy to build and install cabinets. After countless times on the project the cabinet guys work has failed and failed. After speaking with my customer after the 6th time of them on the the project we allowed them todo there job.
