I have a contact lately, the owner issued me a notice to proceed, but right after we mobilize, the owner verbally stopped me, for the reason, that the Area/lot has another claimant.. After 5 months of waiting, the problem was resolved.. My question, Do i have to claim additional cost for the delay? And what provision do i cite if merit? Thanks. ...Read More

WHAT DO I USE FOR PROJECT TYPE? We have been contracted to install the field at the new soccer stadium in Austin TX. The City of Austin leases the land to Austin Stadco LLC. (I don't know who retains ownership of the building.) Austin Staco LLC contracted the work out to Austin Commercial LP who is the GC. We are a SUB of Austin Commercial. We are constructing the field. The team is owned by a private owner, Two Oak Ventures (Formerly known as Precourt). I ask because it is a private team on land leased from the city....Read More

notice of commencement had only re-roof listed on it. other work was performed as well, all through an insurance claim. after all work that GC and sub contractor was to preform was done we had a verbal agreement of what was due to him and what I would recieve back from the insurance company money. The checks were cut I thought all was good. Then, two weeks later GC is saying I still have a balance with them? When we went over final billing we each had the same paper work with the same numbers. The GC is a roofer and the roof was totally completed. He sub contracted out the other work which needed to be done which also has been completed. The GC is now saying that the numbers weren't correct and that I still owe 1499. He has never produced any documents to show proof. The money that came back to me was for things not done at all. For example, content manipulation. I did that myself. GC stated they went off of the scope of loss for pricing so there was no other form of contract or invoicing. the amount on the contractors lien filed with mortgage company was met and then some. GC never changed that paperwork. at this point insurance company is done with the claim....Read More

We are a soils & foundation stabilization contractor doing work around outside of each building in a COA community. Technically, we are not working for unit owners, rather for the "Association" since I believe that the property outside of and around the building would be considered common areas owned by the "Association". Would each unit owner for each of the buildings need to sign NOC?...Read More

We sent a NTO out through Levelset for a project and we did not have the name of the GC at the time. The request for info per FL 713.23(1)(b) was included at the bottom of the notice. The notice was sent to the correct property owner. We did not receive any info from the property owner about the GC. We subsequently identified the GC on our own as we ordered our Notice of Intent. The GC is saying we have no right to lien because they didn't receive the NTO. What is our next step? Does that FL statute protect us in any way, preserve our lien rights, if the property owner doesn't send us the requested information?...Read More
