What is the best way to get a NOC? We have filed preliminary notices, but do NOT get a NOC in return.

Owners on private projects are required to send you a copy of the NOC if you have sent preliminary notice. Unfortunately, the same requirement does not exist for public owners. The best approach is to have a title company monitor title for the recording of a NOC. You can also have a title company provide you a property profile which is a summary of everything on title. If a NOC has been recorded it will show up. If you have served a stop payment notice and provided $10 to the public entity, they must notify you within 10 days of recording and NOC.
