FloridaI just got a call from the "owner" associated with this project and it is incorrect. JKC owns a daycare stand alone building. She said that there is a vacant lot next to her but that the address removes the "Crossing" in the address, this could possibly be the issue? I know that the GC and Sub are correct. FloridaWe are a G.C. working direct to the owner. We haven't been notified if the owner has submitted a Notice of commencement. We just received an executed subcontract back with both NOC and NOF. This is our subcontractor. Do we file a NOC?
OhioThere is a house in Lee County Florida owned by 2 Trusts. She is the Trustee of one Trust and me, my sister and her are Co-Trustees of the other Trust, but with a requirement of a majority vote of trustees to act. My step-mom signed a Notice of Commencement without consulting us and did so on behalf of both Trusts. Is that illegal?
FloridaI represent a steel supplier for a project in south Georgia. This is a big project with many subs, my client being one of them. There is a major dispute with the GC over alleged chargebacks and unpaid invoices. We are still within the 90 day time frame to file liens on the property. However, a Notice to Contractor was not sent by my client. A NOC was provided late but it is not signed by the clerk of court. I am verifying whether or not it was ever filed.
One point:
1. We do have privity of contract, a direct contract with the GC. It appears that although best practice would have been to send a NTC, it is not required by Georgia law because of the existence of the contract that we have with the GC.
Question: Am I correct in believing that we can go ahead and file the liens in absence of a NTC because we do have privity, directly contracted with, the GC?

GeorgiaI have a project in Georgia, GA is a state which you need a NOC. I have requested the General Contractor to send to me. They are telling me that I need to send a Certified Letter Requesting. They have also told me that it is a GA Law/Statute? Why can't I just send an email and aren't NOCs public documents. Isn't Email (kinda) considered a legal document.
