We hired a gentleman to clean up our basement after the septic backed up. We asked about how much he said less than $800. During this time he asking could he stay at the house during the winter. Its empty were fixing it up. He said he would stay there and we pay him $1000 a week plus free place to stay. We informed him we cant afford that well after that he was rude and we received a bill for twice as much when we asked why he sent another bill charging us $225 more for a lien we just received the bill 3 days before. Can he do this and on top of all this he didnt complete the job left it worse were going to have to hire someone else. Is it an empty threat. Seems like he shouldnt be allowed to do this. We told him we would pay fair price there wasmt a contract and he cant double it and not even do the job. Plus he put down ge worked 14 hours he didnt . Sorry so long just frustrated and when my wife tried to talked he talked to her like she was 2 years old even starting f explaining how water runs down hill. Not professional by any means. I am a Contractor and I pay my guys sub pay. I hired a guy and I paid him for his hours that he turned in on a signed time sheet. I require signed time sheets, that I provide, to be turned in on Wednesday for payment on Friday. Things did not work out. He came to work on a Thursday, first day of pay period, and I had enough. I let him go and told him to submit his time sheet. I have not received a signed time sheet therefore I haven't paid him 68 dollars for the four hours of work. We contracted a company to install solar panel system late last year. The project was financed through loan and company was paid in full when panel system was installed, but not fully functioning yet. I learned the company laid off all employees and closed their business down on 11/24/2020. I filed complaint with CSLB and found all assets of the company have been sold off by investors after the company defaulted on loans. There are no funds available to pay off liens or subcontractors. One of the subcontractor filed mechanic's lien and I just received SUMMONS from Superior Court. I need help to either negotiate settlement with their attorney or process of the court procedure. I have paid the project in full, and is now paying for the loan monthly. Would I be required to pay for the project twice because contractor did not pay the subcontractor?...Read More

We sent a SN release. The GC has not received it although the owner has. We have provided the GC with a PDF of said release. However, the GC is stating that they will not release the payment until they receive a "wet" copy of the SN release. My questions is, can they legally hold our payment if we have released the lien?...Read More

HI, my parents worked on a new house adding the Siding to it back in November. They have not been paid for that house yet. The vendor who they worked for to finish that house owes them $4,700. The vendor said the company never paid them, but we got in contact with the company and they had already paid the vendor who has not paid us. We were told that we maybe could file a lien to get the vendor to pay for the job the was finished in November. Is that true, and how can we file a lien? Where can we get a Lien Form to file out? They claim that our lien is not valid because of the timing of "fund trapping notice and intent to lien." Also, they claim that the lien was incorrectly filed against real property and not only against Valvoline's leasehold. I thought the intent to lien was voluntary... Do we lose the ability to lien for the full value of the contract if a notice was late? Any advice would be helpful. ...Read More

I'm the owner of a new condominium apt in NYC. Closing was Feb28,2020. I met the contractor in Feb at my apt. He quoted $10,000. to paint my 668 sq ft apt. stating it required 5 days. I stated it required only 2 days and offered $5000 which I felt was ridiculous but my need was urgent, there had been delay of many months and now the lockdown was imminent, and I was anxious and exhausted.. He insisted on the 5 day quote and I gave in. The job was done in 2 days. It was painted in the wrong color. He now threatens to take out a Mechanics Lien although he failed to stay in touch and I became ill on March 13 the day I moved/ State of Emerg. It took months to recover thru the summer. I am 79. yo.widow. I feel he took advantage of me, essentially scamming me. However I have offered to mediate. In October he unexpectedly accosted me in my lobby, concierge had to grip his arm to steer him away from me. The woman who recommended him has sent me a nasty letter threatening to slander me at the organization through which we met. She said the contractor will be taking out a Mechanics Lien, adding he intends to charge interest.
