Unless the subcontractor sent you a timely proper preliminary notice, he has no lien rights against your property. In that case I usually send the sub a very strong demand letter, along with an already prepared Release of Lien form, for the contractor to sign and have notarized and return. Many contractors know how to put a lien on but not how to take one off. If the sub did send you a preliminary notice, I would have an attorney review it for you to make sure it’s valid. I would also have the sub send me copies of his subcontract with the general contractor and invoices showing when the work was done to see if the lien was timely. The preliminary notice only covers work done 20 before the preliminary notice and all work done after that. It could be that the work he liened is not covered. I’m happy to answer any questions you have about this.
