My mom recently built a house. During the process, she repeatedly asked the contractor for invoices as well as an itemized list of all money used and what was left so she had an idea of where she could spend our not. He never gave any of that and went over budget by somewhere around 50k. She moved in and found that all the work had not been completed that she had asked for, as well as things did not work properly (ie. doors don't shut completely and water gets through.) She asked for these things to be taken care of and he assured her they all would. Then he comes back and says if she doesn't pay for the rest of the services , even though they aren't completed, that there would be a lien put on her house. She ended up paying even though not all things were completed and now has paid for services not rendered: -Door still leaks water when it rains -Cabinets not installed - Custom closet not done to agreement - Trim around doors uneven with walls - Not painted in certain areas He says she changed her mind too much so those are her issues too deal with. Does she have a right to sue over these issues or is she basically SOL since she paid already. ...Read More

We had a prefab addition put on our current home . We contracted and paid in full the agreed amount for the completed addition with a company known as RDA Modular Homes. We are getting ready to sell the property and our realtor brought to our attention a contractors lien on the deed. We do not recall receiving any notification of the lien. We believe that the lien was placed on the property by one of the subcontractors of RDA Modular Homes. One question I have is it legal to apply a contractor's lien against a property for services that I paid RDA Modular Homes in full for? My second question is how many times can I be held liable to pay for the same service....Read More

I had a contractor work on my kitchen remodel. Start date was suppose to be on 17th of May with an end date two weeks. They completed some work and then he didn't show up for 3 days within those two weeks. I took a day off from work for him to complete some electrical work and he didn't show up. My counter top was delayed for a week due to poor measurements of the cabinet spacing. There is noticeable unsatisfactory work done on the kitchen. I had to hire someone else to do the work as he backed out of the job and didn't want to show up as I had requested. I then stopped the payment of 1900 due to loss of time due to paying another person to finish the work. What should I do now as he is threatening me with a foreclosure on my house. I am the contractor that furnished the contract the the customer for a solar project. The contract clearly states that there is a 3 day right to cancel. We provide a professional site survey for the project to see if the the residences roof and electrical is safe to install solar. We had a master electrician review site inspections to give us the clear to move forward with the next step. We hire a professional engineering firm to provide us, site plans, structural load calculations, and electrical calculations. All material was reviewed again by a master electrical and approved. We furnished the labor to apply for permits. We furnished the labor to apply for Interconnection with the utility company. We set up the logistics to drive material from the wholesale supplier to the residence, a 200 mile drive. The day of installation, the customer signed off on portion of the material from the supplier and did not allow us to place material on his property. We furnished the labor and rented the storage space to store the solar panels and all materials associated with the project in the city where the customer lives. Greeting, First of all, I would like to thank you for giving me a chance to ask about a thing that is important for my job in my company. I am working as a Contract Specialist in a Chinese company in Georgia on an international Construction Project. Our contract signed with the Employer is FIDIC MDB2010. Currently, as a Contractor, we have 9 months construction delay. However, the Contractor has 2 accepted claims that have a continuing effect: 1. Covid-19 epidemic claim (submitted under SC 8.4(d) and 8.5) 2. Right of Access to, and possession of the Site, which was delayed as a result of the failure of the Employer (submitted under SC 2.1). The Project scope is 10 km. The Contractor has possession of the Site for 9 km, but there is no possession for 1 km yet. The Contractor requests 9 months EoTfC without additional cost for the first claim that has been impacting the whole project works, and 7 months EoTfC with additional cost (plus profit) for the second claim that has been impacting only the works to be performed in the scope of aforesaid 1 km. My question: in case the Contractor is granted 9 months of EoTfC without cost for the claim of Covid-19 epidemic, can the Contractor be entitled to additional cost for the claim of right of access?...Read More

I have a current contract with approved change orders. There is a large balance due. Due to a disagreement with the client, we will not be performing aspects of that contract, and have issued a Change Order to reduce the amount of the contract, however the client has not signed it. Therefore, legally, the contract amount has not changed. I'm at the point I need to file a lien, I don't want to use the wrong amount, but I know I cannot add to a Lien once it's filed.
