Hired a contractor to replace fascia. Project started first week of February 2020, completed first week of March 2020. Six weeks later found damages. We are about to complete a $250,000 mechanical system for a bridge. I am sub to a sub. My client tells me they will not be paid anytime soon and are in litigation with the GC. Neither my client or I am at fault on anything with this project. The GC is a mess and dragging everyone with them. Terms on my contract are 20% after drawing approval (which was paid years ago) and 80% net 30 days after delivery. Hello, I have a question regarding which party should hold a bond for excavation activities. I work for a prime utility engineering company and we frequently require the services of a subconsultant to perform small utility excavations (i.e. expose a pipe at one single location). Because the bonding process is new to our company (we only just started including excavations as part of our scope of work), we are trying to determine who should procure the bond - us, as the prime, or our subconsultant, as the excavator.
