I have a customer who is doing a job for the government (IRS). I've already filed a lien on the control portion of it and now there is some parts that weren't paid for up front. Can I add the parts on to the lien filed for the controls or do I have to do a separate for the parts? I want to make sure that I have everything in line for the lien since its a government job....Read More

We have a dispute with a builder (in Ruidoso, NM). The laminate flooring was installed incorrectly (according to two independent inspectors). Builder wants to get final "retainage" payment, calls the reports of incorrect installation "bullshit", but it is my understanding that the "retainage" is specifically for the purpose of making sure all parts of the job are complete. I have seen different amounts to calculate an amount to withhold. The cost of materials (if we have to rip out and start over) and install is more than half the retainage. I suggested paying half, and either the builder remedy the install or I find someone else to do it, pay them, then pay the builder any left over amount (if any). Should I 1)pay a partial amount now 2)not pay anything until bids and other contractors lined up and I know the costs better or 3)another option? Thanks!...Read More

I contracted with a General Contractor for a kitchen remodel. Finally work was completed and final payment to contractor was made on 8/25/22 check cleared the bank 8/29/22. My company was hired to wire up some new freezers, cooler and add a new fan panel for the freezer and cooler. During the duration of Construction the store had two other electricians there, the Costco electrician and another they called for service work they were constantly adding new circuits or demoing circuits from existing panels. The GC demoed the old freezer and had me disconnect power from fans, door heater, and lights. during this time the GC/ HVAC and refrigeration started draining all the oil and gases from the refrigeration lines on existing racks. Costco called in a HVAC/Refrigeration company to trouble shoot lines and EMS controls. Now the GC/HVAC and refrigeration company is back charging me for the service call. How do I disputes this with a letter?...Read More

A roofing contractor just re-roofed my house. before he started, i pointed out my refrigerated a/c units that are outside, on the ground, and said it is very important to protect these during the process, they are fragile. he assured me he would, nothing to worry about. During the re-roofing, i walked outside to find one of his employees standing on my oldest a/c unit. I told him to get down, asked if he had been doing that all along, and he admitted he had. i texted the owner who told his foreman to put a stop to it. But i have previous experience with someone standing on one of these units, and rendering it inoperable, due to cracked coils or some other mechanism. we can't test the coils until its warmer outside so i want to withhold payment of $5000 of the cost until i can have it tested. This should be a reason that a mechanics lien cannot be filed against my home, shouldn't it?...Read More

I'm a roofing contractor. I specialize in helping property owners get insurance claims for roof replacement for hail damage. I have a signed contract to replace several roofs for the same customer (located on 3 different properties) but all the work is part of one insurance claim for hail damage. The properties were all insured on one insurance policy. My contract line itemizes all the work being paid for in the insurance claim that I was instrumental in getting his insurance company to pay. I was given a sizable deposit by the customer upon his signing of my contract. My customer is now saying he will only allow me to replace one of the roofs and is refusing to honor his contract for the replacement of several other roofs itemized in my Scope of Work that he signed. The amount of money in dispute is $200,000. He informed me that he would only honor a portion of our contract PRIOR to my performing ANY of the work at all. I am about to begin work on one roof in the contract he has agreed to have me replace for $196,000. But he will not allow me to replace the other roofs I have under contract with him to replace. He's not saying why, but I know it's because he just wants to keep the insurance money....Read More

A contractor did work on my house. I paid him in full with 2 different payments. He did not finish the job and the work was unsatisfactory. I pulled back the last payment from my credit card. The job did require a building permit that is still not closed out with a pass or fail tag. The contractor has cut off all communication with me. We have a new customer with a $600.000 job. They have sent a Letter of intent from PacifiCap Construction to them to us. It says : As project funding has not closed and is contingent upon closing of the permit, our customer and its sub-tiers are not permitted to perform pre-liens against this project, the project site or project ownership. In the event a pre-lien is required by us to begin material orders our customer and its sub-tiers will be required to issue pre-liens to Construction Company directly.
