When selling directly to an owner (BOE, Hospital, Church, County) do we need to file a Notice to Owner or Notice of Furnishing to retain lien rights? I'm supplier. Material on 12/19/19. And it's installed on driveway The homeowner is State Trooper so we can not search who owns the house. He said he already pay the contractor, so it's not his problem. The contractor disappear and don't pay us either In this case, can we file mechanic lien? We come to State Trooper's house on 02/14, he said he never sign owner name when he received the mail so we can't file lien, he said he aked the lawyer already. I have a question about filing a NTO. We are the 4th tier subcontractor for a job. Owner, GC, Sub1, Sub2, then us Sub3. Are we not able to file a NTO? we are new to levelset and sent our first preliminary NTO. We were told it was a friendly notice that we were protecting our rights to be paid from the project. But having seen the actual document sent it is written with more legalese than we expected. We had this sent to our customer and between the time we requested it and the time they received it they paid their final invoice. They are now calling us, rather upset with the wording of this and want us to send something that says its rescinded. In my mind there is nothing to rescind since its the Preliminary NTO. We will send them a paid in full invoice. I am looking for guidance on how to explain this to our customers when they call. I called levelset and they said I should ask the question to the lawyers since they felt they couldn't answer it fully. I don't know if I have explained this well enough. We are a painting company in FL. A lot of the time time we are working on existing perimeter walls (around neighborhoods, etc). With this being the case, I have no NOC and no official address as it is just a wall. I looked it up on property appraiser and it looks like the wall stretches across multiple parcels. My NTO was sent in the first 45 days of being on the job, but I didn't have owner information and couldn't find it. I sent the NTO to my customer, who is the GC. We're now past the 45 days to send the NTO, but if I can find the owner and resend the NTO, would that protect my job? Or am I out of luck as far as meeting my NTO requirement? Are there any provisions for amending an NTO after the deadline? Thanks....Read More
