Parties hired directly by the property owner aren't required to send a Notice to Owner in Florida. So, if you were hired by the owner, then a Notice to Owner won't be required to preserve mechanics lien rights. I'll also add that a Notice to Owner isn't really a claim or an escalation document. So, if you're struggling to get paid, it might be worth considering using a payment recovery tool - like an invoice reminder, demand letter, or even a Notice of Intent to Lien - to force payment. And, if less-aggressive options don't work, then pursuing a mechanics lien claim just might do the trick.
