I was hired by a Colorado GC to install as specified in the plans provided by the architect (this included which specific products to install). There is an issue with the manufacture of the products themselves, but they were installed properly. I am being told that I have punch list items to complete because the products are not working correctly. The products are defective, but install was correct. The GC should have already received 3 draws on this project, but is saying they have not received any payment. There is a pay when paid clause in the contract. The project is in CO. Due to the corona virus, the site (it is a visual arts center owned by a university) is shut down so I couldn't do the punch list even if I wanted to. What steps do I need to take to preserve my lien rights? How can I send an NOI when they aren't even open?...Read More

Im a contractor whose property is being held and invoices are not being paid by the homeowner. she has openly committed defamation of character as well as broken liable laws in the state of Colorado. i have all communication as well as open statements made on google business, thumbtack etc etc. she has single-handedly destroyed my abilities to work in the area with all the lies, etc. i want to any and everything possible to sue and to press charges. everything ive looked up shows im in the right. she refuses to press charges because she openly knows shes wrong and the officers have stated that as well. i need a civil attorney willing to take the case ive done all the leg work and have all the documentation. i need to know my options and i need to move forward asap before i cannot...Read More

So I worked for this company sence 11/23/2016, my first year I took a vacation I recently got fired for missing a few days. One of these days I was suspended for a week. One of the other days I was supposed to be on paid vacation. As well as Monday before. Which I never got paid for. So I am wanting to put a lien on one of his job sights for payment of vacation time. Another reason I want to put a lien on them is at begining of year I got all my DeWalt tools stole out of job trailer. They filed insurance claim. They got check for stuff that was stolen. Told me that I needed to produce a receipt. So I did. They said because it was out of a receipt book they wouldn't reimburse for it. The second time I recolected a bunch of tools. The trailer they were in burnt to the ground at job site. They first said I wouldn't need receipts for my stuff. Went back tried to get me to give them my receipt. Since they never gave me back my other receipt. I knew better than to give mine to them. They would find a reason not to pay me. Both times they got a insurance check. Never attempted to reimburse me for tools. Do I have the right to file lien on either cases. One for loss of wages. The other for reimbursement of tools lost at job sight. ...Read More

We were hired to complete a radon project at a private residence where a deposit was collected and labor, parts and materials were scheduled and purchased. Upon showing up to the property, we discovered the information we were given multiple times by the owner was grossly incorrect. As a result, we were unable to complete the the project to the original scope and plan that day and a further assessment and further expert advice was given to the owner at the property. The owner and our company agreed to expand the project to meet the owner's requirements and a follow up quote and proposal was provided. Our technician was on site for 1.5 hrs and over an hour of travel time was required to get to and from the site. The home owner then decided to hire a non-radon certified professional (a plumber) and decided to not use our services going forward. We are now requesting that they pay the now overdue remaining balance for the original project we were hired to do which they have refused to pay. Are terms our clear that the the remaining invoice is to be paid on the day of the installation and we only agreed not to collect on on the day given we would expand the project. I am now going to retroactively apply late fees, accrued interest, etc. per our terms but I need to know if I add this to the final amount we will be seeking in a lien? I also need to know if I apply the fees to file such a lien if needed and service fees from Levelset in the lien amount? Or do I add these later if a lien is required to filed? If we closed through a Title company is the Lien against my home valid? What level exposure does a homebuyer have? I am a project manager. I was hired to find a gc, all subs and all supplies for basement remodeling. Client decided to not pay anything above what I paid out and we lost 20,000.00 that we were really planning on when we got nixed from the job. On a deadline of a baby due date we busted our tails to complete on time. The drywaller that was hired through another gc on the project (framer) , was paid in full and decided to go to the homeowner and say he was not. He ransomed the job for almost a month. So to be done in time,, we hired our team to go in a knock it out with us.. We bought all supplies and half way through he shows up. He talked bad about all of our work (that was not complete!!!) and the homeowner listened to him and not me. Not sure why. He told him that it all needed to come down, drywall and all. (He hung the drywall btw) HO heard he could finish faster and not only paid him AGAIN, but paid him 5000.00 to tear out everything we did. It only needed to be sanded and thats all he did.. He never removed anything! HO said he'd take care of it, and we could go. Mind blown. I think my only option is to file a lein to be reimbersed. Is that correct? I put in 3 months of work on this job. We did everything. We hired electrician, plumber, hvac, bathroom, carpet (which I canceled) framer, insulation and GC. I applied for and obtained permits, and met inspectors, with GC and was there for every thing that needed to be done. My team was there, my company was very much responsible for the successfully completed jobs. We need to pay the people who werent paid in the process. We sent an NOI and filed a Lien on a job in Colorado, without Prime Contractor info. We now have that information and are still well within our lien rights period. We have already previously asked the legal team what to do and they said the correct process is to release the lien and refile an "amended lien" as the original lien statement. We have released the lien and are about to order the NOI and then wait the 10 days to file the amended lien. My question is, can I order an NOI normally in levelset, or do I need to send an "amended" NOI the same as I have to send an amended lien?...Read More

As the homeowner who received a notice of intent to lien, what are my options if the agreed upon/contracted work has NOT been completed? Only the roof and gutters have been complete. Garage door, fencing, deck work and painting have NOT yet been completed. $12k of 13k+ has already been paid to the contractor.
