Hello! We do wood and metal fabrication. Generally, we install what we fabricate and I file a prelim when we sign the contract. Sometimes we fabricate something (a decorative metal panel, for instance) and just deliver it to our client. Do I need to file a notice in this case? Thank you! ...Read More

I didn't file a preliminary notice on time - but the owner didn't say anything about it. Can I file a lien later, if I need to? Isn't it the owners obligation to raise the issue?...Read More

We're a Contractor working with a housing property company. We're furnishing and installing unit pavers at each unit. There are multiple units. We're being issued POs for each of these units and the contract total is not yet known... Should we issue a Preliminary Notice for each unit or should we issue a Preliminary Notice for each batch of POs issued? The POs are all under one main contract. Note that each unit has its own address. This will end up being over a million dollars, so we're wanting to make sure we have all the correct information and we don't lose out on money should anything go sideways....Read More

I am the sub who is behind paying for his material because of disputes on another project. A rep from the supplier came to the job and threatened to lien the property. I tried to get an installment agreement to pay off the debt. The monthly I could afford was not enough so they demanded payment in full or else they would lien the property and go after my license. The general contractor freaked and paid them 5,000 and I was supposed to match that to keep the supplier from releasing the hounds. Well I somehow scraped that up but missed my mortgage payment which disqualified me from getting an equity loan which would have paid them off. I had already put time and money into making repairs on my house to qualify. Now the general wants to pay them again and deduct that from money that he owes me. I do not believe that the material supplier filed a preliminary notice, hence my question. Thank you....Read More

When I issue a Pre-lien on Levelset, I link the project from Procore, and I can create the document; however, when I do this, I cannot find again the project to create another pre-lien, and if I go to the project and create another Pre-lien for the second contract, it took the last one as a valid document. My question is, Can I issue a pre-lien for each contract under the same project? ...Read More

Hello, I am a counter top fabricator/ installer and I haven't been paid for a project thats been going on, its been over 3 months since I was on the job site. There is a kitchen counter top that was cut short and I re-made the piece for the contractor, yet he said he will install it himself so I cannot get into the home. Im guessing its because he doesn't want my clock to restart in order for me to file a lien. Since I am not completed with the job, can I use this against him and file a preliminary lien ? I am a bit confused and trying to find advice on what to do....Read More

Entered into a Contract with a Client for an ADU (accessory Dwelling unit) in Southern California. Discounted original Contract/Bid from $182.5K to $160K. Started work (without the contracted First Meeting), And essentially completed the unit. The last payment of $2,000.00 is all that remains. Client has requested a TRUE and CORRECT copy of final billing showing all that is left undone and incomplete (under the contract). Am I able to file a Mechanics Lien NOW or a Notice to File...? I have already filed a Notice of Intent to File Lien... and have received several letters asking for the TRUE and CORRECT copy of the final invoice and itemizing What is left Unfinished......Read More

We (a dry utility distributor) were struggling to recover payment (and communication) from a contractor for some time now & so are moving forward with issuing a lien against the property they are working on. Turns out not only the location for material drop off was incorrectly given to us for the prelim notice, but so was the owner & construction location. Now after they've been put on hold with us; we've found out that they are receiving material from a competitor. Can they (a contractor) get in trouble for knowingly providing us with false prelim info?...Read More

I'm a contractor working on a smaller residential construction addition and conversion. The client kept putting off signing the contract, we began because they were family friends and said they would sign once one small item was figured out. Now they are $50,000 behind paying me, and her son has indicated that they are looking at hard money options to close the project out and this would lead to selling the property. I didn't file a preliminary notice. How do I go about getting my money and putting notice so i'm reimbursed if the property is sold? ...Read More

I was recently told that Home Improvement Contractors (i.e., kitchen remodel) are not allowed to provide a Time & Materials contract - that the contract must be a set price and any changes to the scope of work/price must be covered with a Change Order. I'm looking for the statute or ordinance to confirm that it is not legal/permissible for the Licensed Contractor to issue a T&M contract. Can anyone help?...Read More
