I'm a subcontractor working on a large project. We finished work and are not receiving final payment even after filing a Mechanics Lien. Our Mechanics lien will expire in 9 days. We contacted a lawyer and we were advice to do not make the Mechanics lien effective as the amount of money owed will be simnifically less due to all filing and lawyer expenses. We were advise to wait for contractor to fix the problem as they are also going in a legal matter with client. We were told that this was the best practice because we still have 4 years to enforce contract if non payment is received. However, I would like a second opinion. Contract balance is for $30,107.00. I'm a contractor working on a residential project. The owner is in another state and has a tenant in the house. The tenant has been uncooperative and has become such a pain with verbal abuse and threats that we are not able to do our job competently. We are working with the insurance company liaison office and they have directed us to pull equipment from the job, which we did 2 days ago. The owner wants us to continue work, but the tenant doesn't allow us in the residence as of now. Does our company need to file a Stop Order at this time as we have not completed the job. We have a fixed-price contract with a major government organization. I created the internal budget for this project and it equates to our staff spending 500 hours on the engagement. Our original prelim notice that we sent out listed the end date of mid-May, however due to various reasons (some out of our control) we have not completely finished as of 12/10, however we are close. We supplied a 20-day prelim as a trash bin supplier on a private job. We entered the wrong person/company who ordered the trash bin on the prelim. We also didn't check to see if there was a lender on the job and there is. Lastly, our company is operating as a DBA and we didn't enter our name correctly (example "John Smith d.b.a ABC material supplier"). The owner sent an email stating the the 20-day is wrong and identified all of these issues and requested that we resend the 20-day with the correct info. We felt it was a trick because if we sent the update, we acknowledge the original was wrong and also, then our timing is such we lose our lien rights because the new 20-day would be late. We are a supplier and I am having difficulties getting across to our customer that we do not supply Conditional Waivers for progress or partial payments unless we are paid for supplies. I am new to this system and am trying to understand fully what the process is for conditional and unconditional waiver releases. From the instructions I have, my understanding is that the releases do not get sent until payment is received. Please advise on the process, whether conditional and unconditional on partial payments can be sent before payment is received. I need to relay the process to our customer as soon as possible.
