If an LLC owns the construction license of a contracting company, should the members of that LLC be listed on the license as well? In other words, do they each need to be licensed to bid, perform on projects? To complicate the situation, what if the primary owner of the contracting company is the LLC whose licenses are listed, but not his co-owner who performs the majority of the work....Read More

I am here because Discount Dumpsters, LLC has used your service to file a Notice Of Intent To Lien. My Tenant used said company for having a dumpster placed on the public street so he could dispose of personal property. There was no construction work going on, and I was never a party to the agreement. When the company went to pick up the dumpster a car was parked in front of it and so they could not pick it up. They charged the tenant an extra $200 (above the $450 already paid for the service) for having to return on a different day. Tenant disputed the $200 with their credit card company and were refunded the charge. Then the company used your services to seend me the Notice of Intent. Since I was not a party to this and as my tenant was not acting as a "Subcontractor" and since this was for personal purposes of the tenant, am I at all liable as the Property owner. Does Discount Dumpsters, LLC have the right to file a lien? If the lien is filed will the amount of lien be increased by filing fees, interest etc? PS, I have used the comments section of levelset website to mention these things. Can I presume that my comments have been passed onto Discount Dumpsters, LLC? Can the officer of a construction company enforce a mechanic's lien which was properly recorded in the county in which the property is situated if (1) the lien was recorded with the individual officer's name listed on the lien as the claimant, rather than the construction company itself which performed the work, and (2) the individual officer listed is NOT the RMO associated with the company's license, but they ARE listed as "personnel associated" with the company's license on CSLB's wesbite?...Read More

I provided a Retainage Bond to a GC on a HUD project and the GC is stating that since the retainage is being held by the owner and not the contractor it will not be released until completion. I was under the impression the bond worked weather the project was HUD, Government or Private. Any advice on this? Or RCW's I can refer to?...Read More

Is there a way to submit only ONE (1) lien waiver for every payment made on a job? Or do I need submit a lien waiver per transaction that was paid? I'm at the end of a job and have approximately 50 invoices for the same company. I'm wanting to send them only ONE (1) lien waiver vs. 50 etc. Any pointers or training videos online? Hello, I completed a job for a client who used a 203k loan through Loan Depot. I was paid half upfront. After we finished bathroom the client signed a certificate of completion. As a condition of getting the rest of my money I had to sign a lien waiver. After checking the portal and seeing that 97% of the work was marked complete I signed away my lien rights. Immediately afterwards I received a notice from the client saying that we were being fired for not completing the job. The client will not allow my crew to assess what she claims are unfinished items even though I offered to correct whatever she felt was wrong. She decided to take it to arbitration. Her case was dismissed with prejudice. I made a mistake by not filing a counterclaim and the bank still will it release the funds. It’s been 8 months since we completed the job. The outstanding amount is around 6k. I was willing to settle for 5k. Do I have any options to collect? The check is a double signature check and the job is located in Illinois....Read More
