Guide to filing a mechanics lien in Nassau County

Nassau is one of the biggest counties in New York, meaning the Nassau County Clerk’s wait times could be long. Before preparing your mechanics lien, it’s important to do your research so you can avoid mistakes that get your lien claim rejected and prolong payment even further. This page helps you get started by compiling important information regarding New York’s lien laws and the Nassau County Clerk’s recording requirements.

Below are a few key areas of New York lien law:

  1. Some parties on the construction project can’t file a mechanics lien. The parties who cannot record a lien claim are unlicensed contractors who are doing work that requires a license, suppliers to suppliers, and parties that aren’t authorized to work in New York.
  2. The preliminary notice requirements are limited in New York. In the majority of the country, lien claimants are required to send a preliminary notice to the property owner to preserve their lien rights. In New York, the majority of claimants don’t need to do this. There are a few exceptions to this rule, though.
  3. The mechanics lien deadline is shorter on single family residential projects. Normally, the deadline to file a mechanics lien in New York is eight months; but if you’re working on a single family residential construction project, the deadline to file is four months.
