What is Van Buren County's Recording Backlog?

What are Van Buren County's requirements for recording a mechanics lien?

The Van Buren County Register of Deeds Office’s recording requirements are as follows:

1. Name printed or typed beneath all written signatures must be original. MCLA 565.201 (a) (e)

2. No discrepancy in the names shall exist between the printed names of such person, as appears either in the signature, the acknowledgment or jurat. MCLA 565.201 (b)

3. Instruments conveying or mortgaging any interest in real estate shall state the marital status of any male grantors if executed before April 6 2017. MCLA 565.221

4. The addresses of all the parties must appear on any instrument by which title to any interest therein is conveyed, assigned, encumbered or otherwise disposed of. MCLA 565.201 (a) (f)

5. The name and address of the person who drafted the document must appear on the documents executed in Michigan. MCLA 565.201 A, 565.203

6. Documents purporting to convey or encumber real estate executed in Michigan must have an acknowledgment by a notary public. MCLA 565.8

7. A certified copy of the death certificate or proof of death must be recorded when the instrument of conveyance states “survivor” in the grantor’s section. MCLA 565.48 Do not alter death certificates in any way.

8. Court orders must be certified and sealed by the clerk of the court to be eligible for recording. MCLA 565.401, 565.411

9. There must be sufficient space available on the document to apply the recording information or an additional page fee must be paid (i.e. there must be a) 2 1/2 margin at the top of the first page; b) 1/2″ margin at the top of each successive page; c) 1/2″ side and bottom margins on each page).

10. The Definition of a Page: One side of a single sheet of paper not larger that 8 1/2″ x 14″ with print not smaller than 10 point type, which shall be legible and on paper of not less than 20 (standard copy weight) pound weight. MCLA 565.201 (g)

What are the filing fees to record a mechanics lien in Van Buren County?

The Van Buren County Register of Deeds Office’s recording fees are as follows:

Recording Fees

Recording fees for entering and recording any Deed, Mortgage, Lis Pendens or Other Instrument are as follows: $30 per document regardless of the number of pages starting Oct 1st 2016

*$4.00 of this fee is deposited to the Michigan State Survey & Remonumentation (MSSR) Fund. This fee is not required for fixture filings, state liens, federal liens, MESC liens, State Deeds, or Plats.

For any document that assigns or discharges more than one instrument, $3.00 shall be added to the fee for each instrument so assigned or discharged.

Warranty deeds, land contracts or assignments of land contracts, or deeds that contain a covenant of warranty, must obtain a tax certificate from the County Treasurer’s office prior to recording. A $5.00 fee is charged for the certificate. The $5.00 fee may be included in register of deeds payment.

The cost for copies is $1.00 per page. Include a self addressed stamped envelope if they are mailing back to you.

They accept cash, check and credit cards (Credit Cards are for copies only at this time).

If you do not have the Liber/Page and number of pages of documents, you can call the office at 269-657-8242 so they can assist you with the correct information needed to process your payment. When the office receives confirmation from credit card company that payment has been made,they will email the copy for you to print. Allow up to 48 hours for large orders of copies to be sent.
