What are Genesee County's requirements for recording a mechanics lien?

The Genesee County Register of Deeds Office’s recording requirements are as follows:

1. Signatures must be original and names must be typed, stamped or printed beneath all written signatures. MCLA 565.201

2. Instruments conveying or mortgaging any interest in real estate shall state the marital status of any male grantors. MCLA 565.221

3. The address of grantees in each deed of conveyance or assignment of real estate shall contain the street number or post office address. MCLA 565.201

4. The name and address of the person who drafted the document must appear on the documents executed in Michigan. MCLA 565.201(a), 565.203

5. Documents purporting to convey or encumber real estate executed in Michigan must have an acknowledgement by a notary public. MCLA 565.8

6. A certified copy of the death certificate must be recorded with the instrument of conveyance stating “survivor of” in the grantor section, or shall show by recording information to reference that the death certificate has been recorded in the Register of Deeds office. MCLA 565.48

7. Court orders must be certified and sealed by the clerk of the court to be eligible for recording. MCLA 565.401, 565.411

8. The document submitted for recording must be legible. MCLA 565.201 (g) (iii)

9. Documents executed in the State of Michigan after April 1, 1997, must have a 2 1/2 inch top margin of unprinted space on the first page and at least 1/2 inch on all remaining sides of each page. Exemptions to this include certified documents, surveys and land corners.

10. Documents must display on the first line of print on the first page, a single statement identifying the recordable event that the instrument evidences. MCLA 565.201

11. The type on the form must be printed with black ink; type size at least 10-point type. MCLA 565.201

12. The paper on which the document is printed must be white and not less than 20 pound weight. MCLA 565.201

13. The size of the document and any attachment thereto must be at least 8 1/2 inches by 11 inches; at most 8 1/2 inches by 14 inches. MCLA 565.201

14. A complete legal description of the property is required. The property tax identification number and the property address should also be on the document.

15. All Warranty Deeds, Land Contracts, or Assignment thereof, or any Deed that contains a covenant of Warranty must have a Tax Certification from the Genesee County Treasurer before recording with our office. MCLA 211.135 Effective July 1, 2015 the fee to certify a deed will be $5.00.

16. Death Certificates must be a certified copy with a raised seal. A copy will not be recorded.

17. Documents can be recorded via e-filing, in person, or by mail.

18. Each document sent by mail for recording must include a completed return envelope and a matching “return to” name and address on the instrument, and proper recording fees.

19. Documents must contain the complete name, address and zip code of the party to whom the recorded document should be returned.

20. All deeds that have a stated dollar amount must be presented to the County Treasurer for purchase of revenue stamps.

21. Deeds without a stated dollar amount must include a County and State exemption.

Assignments and Discharges: For any document which assigns / discharges more than one instrument, add $3.00 to recording fee for each additional instrument so assigned / discharged.

Tax Certifications
All Warranty Deeds, Land Contracts, Assignments of Land Contract, or any Deed that contains a Covenant of Warranty must have a Tax Certification from the County Treasurer’s office.

Transfer Tax

Based on the amount of consideration paid for the interest being transferred. There is no transfer tax for Mortgages in Michigan.
