I am an underground construction contractor subcontracting on a project for a golf course community installing conduit and fiber for the residents & property. We were to give the project manager weekly invoices on our progress, they approved the invoices, and our terms were to be paid within 45 days from approval. Currently we are due to be paid on 3 invoices with approval dates of 11/12/19, 11/18/19, & 11/22/19. These were due to be paid on 12/27/19, 1/1/2020, & 1/5/2020 respectively. We have not received any payments yet as of 1/22/2020 and I am wondering what our recourse could be in this situation. We did not file any notice to owner. I'm a flooring contractor in WI I did part 1 of th job in Sept hardwood floors n haven't been paid but home owner gave me $2k in dec while we wait for the draw then carpet in the same house beginning Jan n still haven't been paid. I have a project with a contracted scope and value, but that scope ended up changing. We issued quotes for credits for the work not performed, as well as pricing for extras that we did perform. No credits or change orders were ever issued by the GC, so I'm wondering if the lien should be based on the original contract value or the value after our proposed co's and credits? Hi, I am in Oregon. I see that in Oregon, contractors or subs MUST send "right to lien" notice within 5 or 8 days of stariting/furnishing work. What happens when a contractor has been working for 6 months on a project and then send the notice of right to lien with a service start date which is 6 months back? Can he/she still file lien for all costs that dates back 8 months from the preliminary "right to lien" notice date?...Read More

We had a contract for a new home build in South Carolina with a home builder. We did NOT own the property at the time of construction. Our daughter and son in law owned the property. The building permit and c/o was issued under her name. We didn’t close prior to construction as we waited for a mortgage release on what they were selling to us. The contractor completed the work in October 2019 and we closed on the property in December 2019. The home builder was paid in full and we moved in in December 2019. Rize Properties a general contractor we have done business in the past for hired us and provided a company purchase order for the installation of patio fencing four (4) town homes 303, 309, 311, 313 W. Prospect Ave, Mount Prospect, IL 60056. I was told it would be funded by the end of the year back in November. I am unable to get any call back from their office or project manager after numerous calls. I wanted to know if the addresses where the fences were installed can have a lien placed on them after 4-months has past. Specifically, let's say a property owner has not paid their bill in over a year. Their services have been shut off, yet they still do not repay or respond to attempts to contact them. In such a case, could the municipality file a property lien, or are they not qualified? My understanding is if they cannot file a lien, the accumulated charges remain with the property.
