We engaged a contractor through Coldwell Bankers RealVitalize program. He was suggested by our listing agent. The remodel was to put in a new tub/shower and tile and new walls. Long story short, he did not finish the job we engaged him for- numerous items from the contract/itemized estimate were not completed. He destroyed an existing window and trim, did very shoddy finish work, left cracks in our walls and put in a new floor that is uneven and bumpy. the re installed toilet is on a tilt and runs. the new shower head is not firmly mounted and the whole tub unit leaks. Another contractor reviewed the work and said it all needs to be gutted due to improper construction. The pipes were left hanging in the wall and not secured to anything or anchored. We did not pay him the second half of the invoice total as the job is sub par, incomplete, and the bathroom non functional. Coldwell's program put the initial deposit down and are trying to recoup that money. Can he put a lien on our home or sue us for the balance?...Read More

I'm a contractor and I started working on customers home renovation project back in February of this year. Sadly I'm a bit old school and it was for a friend of a friend. As a result it was a verbal contract as well as through texts. The project entailed more work than originally was requested and the customers' designer often made changes to the plan by adding additional work or changing materials. There have been significant delays in the materials like doors and tiles. Almost 2 months ago the customer stopped making payments. We then met with the designer and home owner and set up a scheduled payments. The customer again with in the last month has not paid for materials or labor, and has said he will not pay me. I'm owed north of $10,000. What are my chances of successfully applying a lien on the property....Read More

We are a lighting manufacturer who provided materials for a job site in Ohio. Our products were purchased from a distributor and sent directly to the job site. The distributor sells our products to the contractor or end user. We have not gotten paid yet, and want to possibly file a lien in order to do so. We learned yesterday that our Distributor is actually going out of business. I am not sure if they are filing for bankruptcy or what their status is. When I spoke with them yesterday, they said they would send me a contact of who to call to find out what and if we will get paid. I have not received anything yet. We are a small LLC company that manufactures steel buildings. We have written contracts for our buildings sales. We manufactured and installed a 30’x44’ building in Derry NH for a customer and it has been completed for a around 3 months now. The customer does not want to pay the balance on the building to us. I submitted two invoices for jobs that I assumed I would probably have a hard time getting paid from, and I was right. They have tried extremely hard to keep from paying me. I filed an Intent to Lien and the customer supposedly authorized payment. The property manager now supposedly has the check, but keeps finding excuses not to mail it to me ("lost it on the reception desk," "wrote the wrong address," etc.). I don't believe this check exists, and I certainly won't get this or any check from them until I take action, rather than make hollow threats. Can I file a lien, even if they actually do have a check ready for me that the bumbling idiot property manager keeps forgetting to mail?...Read More

I am the homeowner who signed a contract for someone to remodel my home after it was damaged. contract stated all materials and labor were included in the quote.Only way they can change is if it was in written request. We are at the end of four months on a two month job. Contractor is trying to force me to sign a new contract for my insurance to pay more and for me to pay more. I was threatened that if I do not pay the difference if they will put a lien on my home and remove stuff from my house they put in here. My insurance company refused to pay any more instead of the Contractor saying they’re going to sue me even though they have not finished the job.
