Hotel Project (Commercial) - Owner signs "percentage of construction" proposal using the AiA Document B102, Standard form of agreement between owner and architect. (2007) Scope creep starts at 2,000 sf, and finishes at 5,000 sf. A $10,000 difference in professional fees from 2k SF to 5k SF. All 5,000 sf permitted by City of Tacoma. They are refusing to pay for the final of the initial 2,000 sf draw and the minor additional "sideways" services. I understand from RCW that I need not file a notice of lien claim. I completed a water damage wok for a home, the rebuild is still in progress by the homeowner with my assistance in writing the scope of work, going over the scope of work with the insurance company and the homeowner. Last week I was at the house verifying measurments for the homeowner and insurance company, I need to give them a pre-lien notice. I should of given the pre-lien notice What work must I perform at the house to qualify for "Permanent Changes" or which of the following will qualify me to give a pre-lien? Change outlet covers? Take more measurements? Or what else would qualify to pre-lien the house (I think the pre-lien must be filed within 10 days of last work?) ...Read More

We've already sent a Notice to Contractor in GA for this job that originally listed as a $100,000 contract. Over the months the job has now increased to almost a million dollars in supplies. Do we need to send any other type of document or notice to be able to protect this large change in amounts? We're in a bit of a sticky situation! We had 4 contracts total for a large AZ commercial job. We sent a prelien for the 2nd and 3rd contracts, but not the 1st or 4th. Everything that we are owed is for retainage or change orders, but I'm worried that I can't file a lien for funds I didn't prelien. Should I have sent updated preliens for the change orders? Can I file a lien without having sent preliens for the total owed?...Read More
