As a subcontractor we installed a traffic signal for GC who was contracted to build a new chain grocery store. The grocery store owner was required to install and pay for traffic signal by county. However once accepted by the county they will maintain the traffic signal, which is located on CR541, Burlington Twp., Burlington Co., New Jersey. Would this be deemed a public or private project. We would like to file a NJ Mechanic Lien but have not sent a preliminary notice. We are at 85 days since last working on project so if its deemed public we are out of time. ...Read More

We filed a 20 day notice on September 21 to the GC and Project owner and then the building owner September 28th for work completed in September. This commercial private project started actually in June and we finished September 26th. We were paid up until until August 1st and then did work for 2 weeks in August and 2-3 weeks in September. The project will probably complete by very early October. Is the owner and general contractor still obligated to send out a notice of completion even with such a late filing of the 20 day notice? In other words just because the 20 day notice is very close to the end of the project does not remove the obligation for the owner to notify us of completion from which we would then have 30 days to file a lien? Secondly should we file a lien for work only in September or also include August recognizing that the work in August might not be covered under the lien as it is outside the 20 day window. A Mechanics Lien was placed on my condominium unit (one of 38 in the condo community) by a company who had erected/installed a telecommunications tower on city property adjacent to the condo community in which I live. My unit was arbitrarily cited for the lien. I never received any notice of the lien until a letter arrived on 9/30/2020 stating the Mechanics Lien had been released approximately five to six weeks after having been filed. I called the person from the Prime Contractor who had sent the release and his only explanation was "They had to have a physical address as they could not use just a street name" despite the fact that no work had been done on the private property of either the condo community nor mine own. How could my specific unit be "selected" for the lien to be filed against, particularly without my knowledge. It is my understanding that this lien and it's subsequent release will stay on my property record for at least seven years. I'm not a lawyer, but somehow this doesn't seem legal. Do I have a legal leg upon which to stand were I incline to pursue any course of restitution?...Read More

We did a job on a "residence" that was to be a convalescent home. The owner added a bedroom and three bathrooms. He specifically asked us NOT to pull permits, which we didn't. When Covid 19 happened, it destroyed his chance for opening the new facility. The job was completed in December last year. About three weeks ago the property was listed with a broker. I want to know if I can file a lawsuit against the owner to hopefully get him to pay? I would appreciate it if you can refer an attorney who can advise me regarding my options.
