Can I file a mechanics lien in AZ without first filing a pre-lien?

I haven't been paid the balance on a Net 30 payment agreement for residential glass work. It has been 40 days. Currently getting run around.

Unfortunatley not. Under Arizona's mechanics lien laws, a preliminary notice (pre-lien) must be sent in order to secure lien rights. For full protection, the notice should be sent within 20 days of first furnishing labor or materials to the project. This notice may be sent late, but it will only secure lien rights for the value of labor and materials provided in the 20 days preceding the receipt of the notice, and everything thereafter. 

If you didn't send notice, that doesn't mean all options for recovery are lost. You may still have a claim against your customer AZ prompt payment laws, breach of contract, or unjust enrichment.
