Ok so this guy owns a pool construction business and they did a remodel and some other tasks for some homeowner. Well he called me one day wanting me to help him with a job over there and basically I never got back with him after he had texted and called. Well he texted again a month later saying I need this done and I’ll pay u 2500. Well long story short he got fired but home owner cause I didn’t show up or watever for like a week due to my full time job and some other things. I was literally alMost done. I completed at least 75% or probably at least 80% of the job that I was supposed to do. Out of that 2500 wat does he owe me or am I entitled to. Keep in mind I’m not in contract or anything and all I have is him saying he will pay me 2500$ cash but I also understand I didn’t complete the job someone else did but I did at least 80% of it. And yes also I’m not really a sub contractor or independ contractor because I had a full time job I just used to work for this guy so he knew that I could do it for him. Thanks. ...Read More
I hired a contractor to revamp an existing deck into a 3 season room with a new walk way as well. He began work on Nov. 1 2019 and said he would be finished by Thanksgiving even though the contract agreed to 90 days, which he said would be in case of extensive inclement weather. Additionally, I gave $9,000 up front and paid $8,200 after it was under roof as stated in the contract. Since then very little work was done. When I called about the end of the contract date ...he said "I'll take your word for it"? There as plenty of great weather before the 1/31/20 deadline and he could have easily finished on time. He does not return phone calls but has answered a few text....one stating "we have a perfectly good place to sit which is under roof, he add to complete other projects that were more needed"?? We checked his website and he completed a similar project on another house in February? What legal grounds do I have to get this job completed? In the state of VA can I get another contractor to complete the job? Again, the contract we signed had and end date of Jan 31,20 and he signed it....Read More

If you have paid in full as specified in a contract but no longer want the contractor to complete the work (e.g., the work is 85-90% complete on a masonry deck demolition and rebuild), can I execute a formal termination of the services? For example, I want to bring in another contractor to complete the job and be done with current contractor due to missed deadlines and not consistently showing up. The job started in November 2019 and was supposed to take 3 weeks (although this timeline is not specifically in the contract). Now, more than 4 months later, the job is still incomplete and the communication has mostly stopped. At this point I have paid 90% of the work (and have a record via cashed checks). The problem I can’t get the contractor to finish, so I want to move on to have the job completed.

Hi, we are a sub-contractor pursuing payment from a general contractor. We have just received a letter from the GC stating that they have issued a Notice of Default and Termination on the project that they were working on (which is the same project we were on also). What does this mean for us in terms of payment? I'm concerned as our lien time is drawing to a close very soon, I think we have another two days to file, so if you could get back to me as soon as possible with regards to whether we should file a lien or not? The letter does go on to say that the GC intends to pursue its claims for nonpayment according to the provisions of their contract with the owner, including amounts claimed by its subconstractors - not sure if that helps. Look forward to your reply. Thank you....Read More
