As a homeowner, we signed contracts to have renovations to our house in Fall of 2019. Work technically began in Jan 2020, then ceased till April. Turns out the contractor had their license suspended for 3 months by the state during that time. In any case, work was provided off and on from late April till late July, though not complete per last contract signed mid May 2020. They submitted the 20 day prelim in mid August, about 25 days after last onsite date. About 190 days after prelim we have received a Notice of Claim of Lien. The "first provided services/materials date" is falsely filled with the date they were last onsite (late july, not Jan or even April when most work began). Do they have any legal standing? We believe they provided false info for the Notice of Claim so the agency would process it and bully us into an overpayment. A majority of the project was already paid for, and we would pay for what was provided but the asked amount is demonstrably more than services rendered. Thanks....Read More

I am an Interior Designer. The contractor that I hired to renovate my customer's bathroom was unprofessional, did not complete the job, did poor work and has charged me with additional fees. The contractor sent my customer an e-mail slandering and degrading my name and my work. I emailed the contractor with a payment offer, he did not respond. He is now attempting to extort money from me by threatening my customer with an Attempt to Lien through Levelset. I have disputed the inflated fee he is attempting to collect from me via Levelset. How is this dispute settled on Levelset? How can I prevent a Lien and is the Lien legal? My customers did not contract him to do the renovation, I did. I am an employee/laborer and unpaid by a contractor for work performed on several houses in FL. I understand can file a lien and do not need to pre-lien or notice of intent to lien or give notice directly to the property owner as I am not a contractor, but am an unpaid employee of the contractor. Is this correct? Also, one of the properties sold and closed in only a few days from completion, I plan on placing alien against that property as I am unpaid for labor there as well. I have given notarized notice to contractor of unpaid wages and listed properties and values for each property that is unpaid. As of tomorrow night they will have no further right to address or challenge any of the amounts. I have a flip house and hired a prime contractor for all work. He subbed electrical out. The sub then refused to do the work after installing only 3 sockets due to a disagreement on site with the Prime contractor staff. My prime contractor hired a new sub who completed the work and passed inspection. Due to a clerical error by the prime contractor, the original subs name was used on the paperwork with the city for the inspection. The inspection passed. On being notified of the error the sub was immediately removed from the permit. But now the original sub is claiming $1000 from me for using his company name to get the inspection completed. There was no labor or materials used by him other than $89 which he invoiced with the $1000. I offered to pay the $89 if he dropped the $1000 charge. Thanks...Read More

HomeWise Builders is handling a remodeling job for the Willis Property owners. The Willis Property is now unwilling to pay milestone payments per the signed agreement stating that they want more things done and wanting documentation showing where monies have been applied, etc. They are contesting change orders that were requested by them and are not willing to pay pricing given for work completed. We have subcontractors that are not able to be paid due to their unwillingness to pay invoice(s) released. Notified early this week that they are making amendments to the original contract in order to pay. I would like to know if I have grounds to file a lien... A local small time general contractor asked me to do a job on short notice the following day. He said he was scheduled to do the install but his team got Covid. So, we did a $2800 job (with contract to him) the next day, Friday Jan 29th. It was such short notice, but I did not have time to collect a deposit. Once complete, he wrote a check (from a Walmart MoneyCard account) that bounced. So, since we have finished the job it has been one excuse after another on why he can’t pay me. Today I went back to visit the homeowner of the house to see if the money they paid him to do the job could be canceled to pay me instead. I found out that he is indebted to them (homeowners) for over a year to do work for them in their backyard, plus they gave him a $5k loan for some reason. He told them he will do their garage for free in order to pay them back some of the money. So, he never intended on paying me anything in the first place. I’m doing some work in a co-op apt. The client didn’t put her items in storage as agreed upon, forcing us to work around them. I sanded 3floors already and stained the bedroom floor. This job was supposed to take 3 weeks but took almost 3 months due to moving her items around and her constantly changing her mind on items already approved on. She went to another company and got an estimate of $6000 to complete when I informed her the changes she keeps making after approval bought the final payment to$44000. That’s when she claimed she lost her keys and needed my copy. After receiving them she asked me to remove my tools and self from her property and isn’t making any payments. As per my insurance I’m not allowed to work on her plumbing or electrical and got the appropriate company to sub the job to. She refuses to pay them also. How can I get pass this?...Read More

We are a GC doing a private job in Texas. Our contract terms with the Sub are "we pay when paid". Our contract outlines that once we receive owner payment, we then turn around and pay the subs. A sub of ours just filed a Notice of Intent to file a lien, but we are still waiting on final owner payment before we release the sub's retainage (also specified in the contract). Does our contract protect us or do Texas lien laws trump our contract terms?...Read More

A former sub contractor sent emails to our customers: (I blanked out names) I regret to inform you as of March 1, 2021, D--- R--- [G-- K---] has not paid the commissions owed to me $4300.00. (20% of net). I visited the recorders office on December 14th, 2020 in anticipation of this exact issue. I wanted to advise you that If I don't receive my commission in full by March 5th 2021, I'll have no choice but to send this through the county recorders office. Due to time constraints for filing. I sincerely apologize, I find myself in this situation and I'm given no other course of action. Mr. ----, of Disaster Relief has refused to pay me the commissions owed. (end) The sub contractor also CCed a fake email of a legitimate law office. On top of that I contacted the records office and was told there are no pending liens that they could find for those customers. What can I do to protect my company and customers?
