CaliforniaMy Contractor has abandoned my new residential home construction project. As a residential home Construction Customer, with an extended Construction Loan, my Bank is in New Mexico, and my new home is in Georgia. The Bank states an Attorney can help me comply with Georgia's process of replacing the ex-Contractor on this project. What are all the steps required to replace him? Is an Attorney required to replace him?
GeorgiaThe project in question was not completed due to inadequate plans and requirement details necessary to finish.
First day on the site is 10/5/21 and last work completed is 12/19/21. We filed a notice of non-payment (over $200k is unpaid) on 1/31/22 and today 2/16/22 initiated a notice of lien.

ArizonaWho is the Owner on a Notice of Completion in a landlord/tenant situation? If the Tenant is the project owner building out their space and hiring the GC, and the Landlord is the property owner - who should sign the Notice of Completion as the Owner?
CaliforniaWe are a GC in Arizona. We received a conditional certificate of completion and a letter of compliance both from the city. Do these documents shorten my lien rights to 60 days? Also I notice the laws state the deadline begins after "completion of the project as a whole". Both the conditional certificate of completion and the LOC reference just the completion of the shell with TI work still to be done. The TI work is to be completed under a separate building permit. Does this extend my lien time to after the TI portion is completed as well? Thanks in advance for your help.
ArizonaI will like to file a Notice Of Completion ti signify my remodel work is complete. My electrical contractor did not file a preliminary notice and last furnished work in April 2021. It is now Aug 4 2021. By filing the Notice of Completion will I be protected against the Contractor from filing a mechanical lien on my property. CaliforniaI am a homeowner who hired handyman for a back porch repair. He said his fee was $50 an hour. When I asked for his estimate he said it would be $400 to $500 dollars total. I agreed to the $500. This was all verbal.
I paid the costs of lumber and paint from Home Depot including delivery.
This project was replacing the stairs and small porch treads and painting the existing railing. He said the existing structure holding the old stairs was sturdy. The handyman was very slow.
Upon completion, he said I owed him $1300 for his labor of 26 hours.
I gave him a check for $600 which was $100 over his estimated dollar amount of $500. He accepted it.
Now, he claims he will put a lien on my home for the difference of $700 for his version of our verbal agreement. He refused to acknowledge that he gave us an estimate of $400 to $500 in front of me and my husband.
How should I respond? Should I file a Date of Completion including a copy of the check given to him?

To get the contractor to complete structural work
District of ColumbiaWe submitted an offer to purchase a 20 year old retirement home to a real estate broker/agent in Michigan for $650,000. The Seller countered, but the offer expired before the counteroffer was received. In the days that followed, on Tuesday of this week, we drove 4 hours to the county where the home is located to get copies of all information related to this property. We learned in the building department that there was never a certificate of occupancy issued after the home was built nor when a major renovation took place a few years later. If we really want this house, what are your recommendations to most expediently take action to make this happen. Can we put a clause in the purchase agreement requiring a certificate of occupancy before we can accept the counter offer or initiate a new offer with requiring CO or do something else?
MichiganIm the co owner of a general contractor construction company, our firm completed an interior home improvement job in city of diamond bar, CA to a couple clients on or about 12/14/2020 to 1/29/2021 . The owners failure to pay $ 20k included materiel with the proof of receipts to us. I tried to ask them to pay via email, text messages etc in properly languages, the owner did runarounds with us, also bullying and threaten my firm, and asked my firm to continue to do some cosmetic repairs to their premise. I asked the owners to pay off arrearages first, then I would to help to do extra touch up or cosmetic repairs. But the owners refused to and not reply to my inquires any more since on or about 2/19. on 3/5 , I received an attorney letter form this group of owners, they asked my company to credit them $10k.... In this case, should I file a mechanic lien or work with an attorney to fight for my justices and right ? Thank you so much. If so, I will!
