File Notice of Completion

I will like to file a Notice Of Completion ti signify my remodel work is complete. My electrical contractor did not file a preliminary notice and last furnished work in April 2021. It is now Aug 4 2021. By filing the Notice of Completion will I be protected against the Contractor from filing a mechanical lien on my property. Do I have to give notice to the Contractor after I file Notice of Completion. Thank you. My email address is benton.yue@gmail.com

A contractor only has 90 days to file a lien after the work is completed. If a Notice of Completion is filed that reduces the period to 60 days for the prime contractor, and 30 days for the subs. If you want to file the Notice of Completion you do have to provide the contractor and subs who submitted preliminary notices with a copy.

Thank you for your quick response. I acted as the Owner and Builder and I have a contractor B license. In my case. the people that I hired are they considered Contractors or Subcontractors. None of them filed Preliminary Notices. Work last performed was in Mid March 2021. Can anyone of these people come back later and filed a mechanic lien on my property without a Preliminary Notice? The reason for me filing the Notice of Completion and to put these people on notice that work has been completed and prevent them from filing mechanical liens. Will I be able to provide Proof Of Serving by sending through certified mails?

If a contractor contracts directly with the owner of the property then the contractor is considered a prime contractor. However, the rules get more confusing if the owner has a B license and used his business to hire the subcontractors. In which case a preliminary notice probably would be required, or at the very least prudent for the sub to send.
