We own a small asphalt paving company and recently received a Request for copy of notice of commencement. We have never seen this before or know what it is or what to do with it. I have researched this, and it looks like it is the property owners responsibility to get one for the project. We typically bid a job, then the customer accepts it, signs, and we file for permits if needed, then complete the job and invoice. Do I now have to get a NOC for each job? Even if we are the only contractor? Please help....Read More

Hello, I work in an Accounting Department for a construction company. On most of our jobs, we are hired as the General Contractor. I am the person that collects a copy of the recorded NOC, files the NOFs we receive from subcontractors, as well as prepare and send lien waivers before payment is issued to subcontractors. I do have a question regarding the NOFs along with lien waivers. Say for instance we are working with an electrical company, ABC Electrical, and they get their supplies from 123 Electric. The NOF that we we would typically receive would be from 123 Electric, and it would state that the "undersigned is furnishing to ABC Electrical." Do I need to have any sort of full lien waiver signed by ABC Electrical for 123 Electric stating that once we pay ABC Electrical, they agree to pay 123 Electric? I am confident in the lien waivers that I send directly to subcontractors with that we have signed contracts with. What I am not so sure about is when we get NOFs from companies that our subcontractors are working with. Per Fla. Stat. § 713.13(1)(d)2, if work is not commenced within 90 days of NOC being filed, the NOC is void. We got an NOC filed on our property on 6/12/20 by a window company. We are 83 days in from that date and no work has commenced. We are being told our windows are not due to arrive till later this month, being well over that 90 day benchmark. We are wanting to refinance our home at the moment due to the extra low interest rates. I am wanting to find out how this 90 day voiding period can help. I have expressed to the window company that I do not want to cancel our contract nor the job, I just want the NOC terminated so we can refinance and file a new loan before the window lien hits our title/deed. We are also willing to resign a new NOC to be refilled after the refinance. Thank you for your response!...Read More
