Per Fla. Stat. § 713.13(1)(d)2, if work is not commenced within 90 days of NOC being filed, the NOC is void. We got an NOC filed on our property on 6/12/20 by a window company. We are 83 days in from that date and no work has commenced. We are being told our windows are not due to arrive till later this month, being well over that 90 day benchmark. We are wanting to refinance our home at the moment due to the extra low interest rates. I am wanting to find out how this 90 day voiding period can help. I have expressed to the window company that I do not want to cancel our contract nor the job, I just want the NOC terminated so we can refinance and file a new loan before the window lien hits our title/deed. We are also willing to resign a new NOC to be refilled after the refinance. Thank you for your response!
