We hired a contractor to do the condo rebuild and have a problem with their bill. Is it possible for me to ask a quick question to one of the attorneys regarding this? The summary of the situation is: We signed a contract with the contractor who estimated $20,500 for the rebuild (the estimate stated it was for "draw purposes only"). In April, I had paid a total of $14,100 based upon the draw schedule and invoices received to date. In May, I asked the contractor where we stood financially as I had not received any further invoices. He said we were "about even". In August, I settled with the insurance company based upon my understanding that we were about even & no new invoices had been received. The next week, we received a bill for an additional $29K. No work had been done between May and August. I would not have settled with the insurance company if I knew we were going to be charged an additional 29K. In August, I paid an additional $10,000 of that bill. No change orders or estimates were ever provided by the contractor even though the contract said that was required. The permit has now been closed. The work done was subpar and there are outstanding issues. Are we obligated to pay the balance due on their invoice since the permit is closed and there were no change orders/estimates agreed upon? Does he have legal recourse to sue us?...Read More

A former tenant has filed a construction lien on my property he used to rent in retaliation for not renewing his lease. He now fraudulently claims he worked on the property as a handyman and was never paid. He is not a licensed contractor or a sub, no NOC was ever filed, no permits were ever pulled, he wanted to paint his room and got my permission to paint and I supplied the paint for him. He also took the liberty to do minor repairs on his own, fix outlets etc. without permission and to install patio enclosure without my permission. He now claims he wants me to pay nearly $12K for the work he was never allowed to do and recorded a lien. What should I do?...Read More

Hello! We worked on a project Dairy central Phase 2 in Virginia. Last delivery was 10/07/2021, we are not paid for deliveries from 05/20/2021, 09/27/2021 and 10/07/2021. On 12/02/2021 we filed a Lien on the property, last day covered according to 150 rule is 05/10/2021 so we should be covered. We also sent Preliminary notice to client and owner on 09/30/2021. Notice of intent to Lien to client on 10/25/2021 Post work Notice on 11/19/2021 to owners and client (we were late if deadline is 30 days after last delivery) Lien filed 12/02/2021 Today we find out, that probably our project address is not exactly correct, as Dairy central project is combined from few phases, and we worked on Phase 2. To the Lien we added 946 Grady street Ave, Charlottesville, VA 22903, but looks like Phase 2 building is located at 400 10th Street NW, Charlottesville, VA 220903. According to 946 Grady street Ave address Levelset added owner name - Dairy Central Phase 1 LLC, but looks like we should change this as well to Dairy Central Phase 2 LLC. On other documents we saw Stony Point Design Build as owner as well, so we listed two companies as owners on the Lien. If Lien deadline is 90 days from last delivery we should have time till deadline 01/28/2022 right? 2. This is my first time and I am having trouble filling out Section A Supreme Court of Pennsylvania, Court of Common Pleas, Civil Cover Sheet for a mechanic's lien. It wants me to check a box for Commencement of Action but I am unfamiliar with the selection of choices, their terms and how they fit my situation. the Commencement of Action selections include: -complaint -writ of summons -petitions -transfer from another jurisdiction -declaration of taking Here is my situation...I am filing the mechanics lien to recover money (~1700) owed to my company by a client after a job was stopped per the client's request. The cost of labor is what is being requested. What is my commencement of action, given the previously stated options? Other questions I need to answer from section A include: 1. are money damages requested? yes or no. I assume yes because I didn't get paid and am looking to recover that, hence the reason of the lien. Is that what this is looking for? 2. dollar amount requested (check 1) * within arbitration limits OR * outside arbitration limits -please advise now, the certificate of compliance... My girlfriend's mom purchased a house that my girlfriend then rented. Her mom wanted some framing around water heater, etc done in basement and also wanted a deck built. Many text messages to prove that she asked for these things but no contract. Her mom was also there in person for some of the deck construction. Payment was never discussed. Her mother purchased most deck materials but not all. Now her mom suddenly wants to sell the house and has already had realtor pictures taken.
