I work for several entities that are development companies. Additionally, we are the part owner and the GC. We are a small company that has grown rapidly within 5 years. I have received intents to lien from various vendors of our subcontractors, whom have been paid but have not paid their vendors. If i do not have a conditional lien waiver for progress payment executed what do I need to provide the vendors inorder to prevent lien? Our contracts state the subs are responsible for their materials, tools, supplies and equipment costs and that amount is to be included in their bid packages- so when we generate and execute a contract the subs and my company have a meeting of the minds that they are responsible for covering their vendor fees. Am I missing a step? Should conditional lien waivers on progress payments be executed at time of contract execution? I just had a water heater installed. They wouldn't do any work unless I paid in advance and I signed papers stating that I was satisfied with the entire project. I signed, but later found that them asking for or accepting a certificate of completion to be against the law in Michigan. Being it is against the law, would that make the certificate invalid? I later found a dent and couldn't get it replaced because I signed saying I was satisfied. Plus they were suppose to do an in-home consultation, but did it over the phone, so I didn't know what model or brand I was buying. I was unknowingly taken advantage of, but I should have researched further before doing anything at all

I am a subcontractor that put a mechanics lien on a property because we were not being paid. I am now being asked to provide the property owner with a waiver release in exchange for final payment. I sent the property owner a final conditional release waiver but he did not accept it and sent me a message from his lawyer which stated: "the document does not have the recorded Document Number. The lien is not yet identified as being recorded. Please ask for this information and it would be best if they provided a copy of the actual stamped recorded lien or receipt from the County Clerk identifying the Document Number."
