Good evening! I ordered a Request for Cancellation and just reviewed the file. The box R.S. 9:5169 is checked and it is not the right one. It is supposed to be the other box R.S. 9:4823. The DWP representative said they would not issue a joint check because the GC's contract has no listed subcontractors. I hired a contractor to fix the drywall in my basement due to water damage. This was an insurance claim, and the contractor was a preferred vendor for the insurance company. I paid my deductible to the contractor, and my insurance company paid the rest. The contractor hired a drywall company to complete the work. The drywall company wasn’t paid by the contractor for the work (it’s only been 30 days since the work was completed.) The drywall company is calling me threatening to put a lien on my home. I once owned a residential property in Louisiana. While I owned the house I had it rebuilt after a storm damage. I have a lien waiver from the GC and the rebuild was completed, was GC paid in full, and I sold the property. I recently received a Mechanics Lien against the property I no longer own. More importantly neither myself or the GC entered into any agreement with the lien claimant for any work. Furthermore, according to RS 9:4802 of LA state law, contractors only have 60 days to file a lien (No notice of termination was filed). It has been more that 60 days since all work was completed at the residential property. Is this a valid lien? As I understand under RS 9:4833 I can request cancellation of the of the lien within 10 days of receipt of lien. Who to make that request with the claimant who filed the lien or the clerk of courts who recorded the mortgage? Finally, is there an example of how to draft such a letter of an improperly filed lien? ...Read More

We hired a company to remodel our kitchen. They started in Nov 2020. Our contract stated for us to pay 50% at the start and 50% after completion of the project. The contractors continued to delay the start date for months would show up some days and would not show up for weeks . They were very unresponsive and we were always quick to answer their texts and calls the same day. The project exceeded the year and we contacted them and they finally finished sometime in March 2021. As soon as the project was complete we paid our final bill within days of them completing most of the work. THey still had some outstanding items that they would later fix or leave undone. Never one time were we asked for payment or told that he would be putting a lien on our home for non payment. A few months ago after we paid him the full amount he asked for our address to send us something. We gave it but it was undeliverable because it required a signature. I immediately texted the contractor to let him know we didnt get it and if he could let me know what it was as it was being sent he back to him. I contacted several times on this with no response. We were due to close today on our home and see that there is still showing a lien on my name even though he has been paid in full for months. He is telling me I need to resolve it on my own and verified that the lien is no longer valid but I need to do the work on my own to get it released. Legally can i do anything here? I do not understand why he would have never let me know I needed to pay him or had an outstanding balance when we had paid him timely all along and now he wont even help remove it from the record. Hello, I have a Home in Wa State with 2 judgement liens...was reading the portion of your article, "in order for it to go away, you have to make it go away…it requires action on your part.”...I've done a little research and it looks like in Judgement liens expire at the end of 10 years unless "renewed" by holder in which they could stay for another 10 years....Both of the liens that are clouding my title expire within 11 mos of today 7-2-21...Question , can you guys help me get the liens removed at the recorders office after they expire?
