Our company provided labor as a subcontractor to a primary contractor for a residential homeowner. The contractor is more than 30 days past due on their payment to us. It is not our customary practice to send preliminary lien notices to homeowners so we missed the 20 day window to submit one to the homeowner. Currently we have a project that is at 95% complete, due to some issues we have been notified that we will not be finishing the project and another general contractor has been hired to finish the last 5%. we have only been paid to approx 75% completion and the balance owed to us just for the last bit of work. Currently we are owed 11500. just for the work that was done. Can we now proceed to file a lien because they won't pay us or do we need to invoice them and have it rejected? I notice the law uses the term at completion but technically the job isn't complete yet and we won't be completing it so can we not file until the other contractor completes the project. Just looking for guidance so when we do file the lien its in the proper order of operations and at the correct junctures of the project. Thanks!...Read More

I am an unlicensed residential designer. License is not required for single family residential up to two floors. A client contracted with me to design a remodel. Because he was in a rush he pulled a demo and foundation repair permit and work commenced while I was designing. He cancelled the job right before I was supposed to pull the permit and now he doesn't want to pay because he says the job was not finished. Does the demo and foundation repair allow me to file a lien? Also, the lender wasn't notified of my contract. Do I have any danger of being sued for slander of title?...Read More

hired as general contractor for new home on lake Athens, Texas. Homeowner only borrowed 80,000 from the bank and was to have the remainder of cost himself. he did not and ran out of money. he then fired me. he owes me 27,000 dollars. I have taken him to court and have a judgement for 27,000.00. Then bank is now going to foreclose this tuesday (11/7/2017). I believe I have a superior lien to the banks lien since it was filed after the mechanic lien and an affidavit of commencement is for the date it was filed. Homeowner name is Terry J. We are a provider of flooring goods and services to the multi-family industry in the Southwest. A key client has asked us to provide goods and services to a new construction project in Florida with an initial value of $400,000. We have licensed ourselves to do business in Florida, but as the one responsible for contract compliance in our organization I am not familiar with the Florida property code and its lien statute requirements. I found two liens that my company filed many years ago (2012 and 2002). They still appear to be attached to the property when searched on the county's assessors page. My understanding is that liens in Washington state expire after 8 months if not enforced. If so, why are these liens still attached to the properties? Do we have any obligation to remove these liens? I been had liens on my since 2008 when house was bill the general contractor never paid some of the subcontractor and we couldn't close on house do to liens been living here since 2008. I was never sued at,all by the general contractor or subcontractor and read somewhere the lien stays on fort ten years question can these liens be remove off house or do they fall in 2018 or can file a petition to remove invalid liens thanks...Read More
